Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Qtc Mental Health Apt
Good evening, This is my first time writing a post. I am active duty Navy and already started my retirement process (19 years and 8 month in, 4 to go). I had my first QTC appointment and I just wanted some feedback. I have been diagnosed with endometriosis, ulcerative colitis, IBS, migraines, plantar fasciitis, back and neck problems Among other things, but the appointment I just had was for a psychiatrist for depression and anxiety. I went into the appointment and I had planned on telling the doctor all the stuff that I've been going through with the depression: not sleeping, no interest on anything but curling up in a ball in my couch when I get home, my mood swi…

ptsd Need Advice
Hello Guys and Gals, So forgive me if I'm posting in the wrong place. Last June I submitted a FDC for 6 different items. Last month it was determined by the VA none of them are service connected. I contacted a VSO and they said the va made a determination from looking at 3 weeks of physical theory records even though I have documented MRIs stating sciatica and two different herniations in my spine. NO CMPs, nothing. They just uped and said none of my stuff was connected. They never had my full service medical records. So I sent in my 300 page record and a current screening for TBI and PTSD, along with a NOD and a new FDC for additional items, to include PTSD and TBI. My…

Tricky Situation - Eating Disorder - Too Request An Increase Or Not?
Here is my situation: I am currently 0% S/C for Anorexia Nervosa. I have a laxative abuse history for over two decades. I am currently in out patient therapy weekly through Tri-West paid for by the VA. It is helping to a point....I have my days... In November of last year I fainted due to my ED and was rushed to the VA ER. I damaged my lower face to include my two upper teeth. I reported this incident to my outside therapist, Chief MH Director of my VA team, and my PCP doctor. Both the MH/PCP doctor's provided consults for me to go to VA dental but Chief Dental Doctor denied all request stating I was not S/C for my teeth...Yes I knew that...So....I had to se…

ptsd Gathering Of Evidence Development Letter
Hi everyone, I am new to this forum. I've been looking through some of your forum for the past couple of months, but this is my first post (so i hope I'm posting in the correct thread). I submitted my FDC in January of this year. I just recently received news that I am in the Gathering of Evidence phase. Please do not judge me for what i about to say. I know many of you served honorably and i only wish that that could have been my case (it haunts me every moment of everyday). I was raped in my Advanced Training Unit and did attempt to exorcise every effort to obtain a discharge to get away from my attacker. My chain of command kept "losing" my discharge paperwork and …

Fully Developed Claim
If I submit a FDC, and all the evidence is already in the VA's system, and/or in my SMR. Do I need to send copies of those reports as evidence? What about an MRI done while on Active Duty? Would they have access to that as well? Semper Fi.

Sanitity Check On Retro Pay Computation...
Ok...need a little sanity check.. my last day on active duty was 11/30/14. My effective date of disability is 1 Dec 14. I received my first regular payment 1 Apr 15( for March obviously). So by my math my retro should be 3 months..1 Jan 15 payment (for December), 1 Feb payment (for jan), 1 March payment(for feb.). The VA paid 2 months and after talking to 2 people they still seem confused because of the way the law is worded about the 1st of the month after disability...IMO that means that is the date you get paid...ie if disabled from 1 dec, you rate a payment 1 jan for December...but 2 people at VA ive talked to so far disagree(granted it was just phone answers). But wh…

Fee Based Dental -- Two Authorizations... Different Hospitals
The dental services for Livermore took my information to Menlo Park for an authorization for fee based dental. A few days later, I got an authorization from Palo Alto (the parent hospital of Livermore and Menlo Park VA dental clinics). Shortly after that, I got another authorization from Menlo Park's dental services. The one from Palo Alto came with a letter to the doctor explaining how fee based works and a blank VA form 10-2570D. The one from Menlo Park had the letter to me only and a computer printout that looks like an authorization. They authorized an exam and prophy and indicated they will approve up to a certain amount for treatment. Last Thursday I missed …
