This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Retroactive Payments
Hello everyone, I am new to these forums and I have a quick question for you guys and gals. I medically seperated form the Army in May 2014 and started recieveing 70% Va Compensation in June 2014. I filed a FDC for sleep apnea and was approved for 50% which raised my total percentage to 100%. They placed the claim on my date of discharge of May 28, 2014. I have four children and a wife. I know I am entitled to Retroactive payment; DFAS completed their audit on my account on Feb 19, 2015 and it was sent and recieved by the VA on that date. After talking to "PEGGY" a number of times I continually recieve the same answer of that it is with the Regional Office in Atlant…

ptsd Pending Decision Phase
Hello fellow veterans: It has been four years and I think I finally retrieved all of my proper information, and ships movements, three buddy letters and doctors diagnosis. I was given 50% Non-service connected two months ago and i Re-opened with my claim right away with the above info. I have been diagnosed with sleep apnea and PTSD. I am at the Preparation for Decision for two weeks, does anybody know how long this phase might be? Has anyone been upgraded from Non service connected to service connected? Any help would properly tame my anxiety.. Thank you folks and hope all is well with everyone.....

The Actual Fdc Timelines?
Folks: After 120 days, my first FDC Claim and my first ever claim ever is still stuck in "Review" at the RO? I took it to heart when I read on the new FDC Process "all evidence" and there's nothing else for VA to obtain? Since day one in the military, I kept or obtained a copy of every single piece of medical records/papers. Accordingly, I also, submitted 14 DBQ's completed with this FDC on 20 Contentions an it's all very well documented. When I asked for status from my VSO, she said the system says VBA is still "gathering evidence"? Also, she went on to say that they all (meaning her claims files) all say that anyway? I said to her, "why", this is an FDC and I already s…

Convalescence Pay For Surgery?
was wondering how this works after surgery? I had shoulder surgery last week and the doctor gave me no work duty for about 3 weeks, then it states that the following 6 weeks is desk only, no lifting, field work, etc. Then after that, it states it will be subject to follow up appointments. I was told by the doctor that full recovery would be about 6 months or so. Just not sure, what part of the limited/no duty/light duty plays into convalescence. Thanks,

Reconsideration?
How long after recieving my decision letter do I have to file for "Reconsideration" ? I ask that question because Monday 4/12/15 I am going to call my VSO and ask him to send me exactly what he told me last week he is doing about my decision. He stated to me that he was going to ask the RO to change the 30% increase to 60% for neurogenic bladder and 100% for suprapubic cystotomy. So if that is true of him doing what ever is needed then I want written confirmation of this and not just a verbal confirmation. Never do trust h/she said from the VA especially. I know no matter what I need to keep track of the date to file a NOD in the 1 year time limit frame. Just lo…

Continuity Of Symptomology Question
I'm aware of service connection by chronicity (diagnosed chronic in service and diagnosed chronic years later). However my question resolves around when the in service chronicity is disputed or questioned. I know the new regulation only allows specific chronic diseases (tuberculosis, cancer, etc) to be applicable to continuity of symptomology. However, my question is does it only apply to specific chronic disease on the list or does it apply to all chronic diseases (chronic bronchitis, chronic sinusitis, etc), but not chronic injuries. All comments are welcomed.

Lung & Thyroid Nodules --->>> Agent Orange?
Hello. I already have a 50% disability (awarded 2012). Well, a few months back, I started having back and chest pain along with coughing. I went to my local va outpatient clinic; they did a chest xray and found pleural thickening. They scheduled me for a CT Scan in Parma, Ohio where I was scanned from neck to knees. The findings on the report are that I have lung nodules and thyroid nodules; Parma did not see pleural thickening. Noted was that the lung nodules should be re-evaluated (new CT Scan) in a year, and they are scheduling me for an ultrasound on the thyroid nodules. This is scary stuff. I had a stress test last year. Next, I made an appointment with a lo…

ptsd Back Pay Confusion Possible Over Payment.
I just received my back pay for my disability claim, but I have not received my official decision letter yet. According to ebenefits I recieved 70% disability for my PTSD. The amount I received in back pay was much higher than 70% would have given me. It is the amount that 100% would have given me. I read that it might be that they gave me iu since I have been unemployed for 2 years. I plan on waiting till I get my letter to spend any money. I have been out of the Army for over 12 months so it is not from that. Any thoughts or ideas?

Osa And Asthma - Revisiting The Question
I'm rated at 50% for OSA with CPAP but was declined "reactive airway disease" or asthma in my initial claim. I'm thinking about submitting a claim for asthma now that I'm on ADVAIR daily. Does anyone have any experience in winning this? However, been reading on HadIt which highlighted 38 CFR 4.96(a) §4.96 Special provisions regarding evaluation of respiratory conditions. (a) Rating coexisting respiratory conditions. Ratings under diagnostic codes 6600 through 6817 and 6822 through 6847 will not be combined with each other. Where there is lung or pleural involvement, ratings under diagnostic codes 6819 and 6820 will not be combined with each other or with diagnosti…

Fdc And Va Educational Benefits
Would me enrolling and going to school affect my pending FDC claim. This is a first time claim for me 9 months after my separation. I'm in the gathering evidence stage now. For example, would they say something like if he is prepared enough to go to school that he isn't really bothered by his mental issues etc. Denied! Is that reasonable for them to do that or am I just worrying to much? Thanks.

My First Payment Is Way Larger Than What It Should Be
I got my first payment for VA disability a few days ago. I little over 14,000. While that is great an all, I searched around and I found my approval letter on ebennifits and I was approved for 50%(around $850 a month) starting December 1st, 2014. The math doesn't make any sense. Can someone please explain this to me? At first I was thinking it was the last installment of my enlistment bonus, but I'm pretty sure that money comes from a the Army, not the VA and I was discharged early so I wasn't expecting that anyway.
