Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Rating Just Upped To 80%. Now Incompetent? Withholding Back Pay.
Well I have a lot of things and I don't know where to start. When I got out of the Navy in '07 I received a rating of 10% for tinnitus, and 50% for anxiety/depression/panic disorder. Also 0% for GERD, 0% for hiatal hernia and 0% for the tendonitis in my ankle I broke while in. In June of 2013 I filed for an increase for my anxiety disorder, GERD/hernia and my ankle. I received a letter this month stating that they were increasing my overall rating from 60% to 80%. They raised my anxiety to 70%, and the ankle and hernia to 10% each. Part of the letter also stated that "A finding of incompetency is proposed." So they will start paying me for 80% on June 1 2014 bu…

How Much More Do I Need...
12 year AF vet here with time in OIF. Just wondering, if I'm already rated at 80%, how much more will I need to get to 100% or totally disabled? I know the formula is complicated, but I'm hoping someone has experience enough to rattle off an answer. My understanding is that any additional rating will be a percentage of the 20% I have remaining--which means I need more than 50% to get me over 90% which means 100%. Is that right?

Confused
I have two ratings for same condition. Back in 2002 I submitted both service connected and non-service connected claims. Both were denied and I subsequently won the non-service claim on a CUE. I also won the service connected claim for same condition that I was granted for non-service pension. Here is where I am confused about. If both claims for granted separate from one another but they both were granted back to the original claim date, then why is it that the service connected claim was only for 30% and the non-service claim was for 100% for a severe heart condition. I was 44 years old at the time I filed these claims. Here is the rating decision: …

cervical strain Mri Results
I had a sit down with a neurologist to review my MRI about my neck problem and what he said sort of shocked me. Currently 20% rated for "cervical strain" awarded back in 09. (They never did the MRI). The imaging revealed degenerative disc disease with 2 herniated discs which are pinching a nerve which makes my left arm basically useless. Bone spurs too. Except the nerve thing, same symptoms I've always had since injury so I'm thinking the VA misdiagnosed me. I just sort of dealt with it but after 2 months of pain meds I had enough. Debating on asking for an increase but not sure how to go about it. Any suggestions would be greatly appreciated. Thanks ag…

Back Injury And Nerve Damage
Wanted some opinions on how to pursue a claim for a back injury that I am service connected for and was given a 10% for L1 and 10% for partial paraliys of lower left extremity.still within NOD period. By regs all Ive been able to find is about and entitlement to 40% maybe 60% with the nerve damage to this injury. I am a little stumped on the muscle and nerve ratings. VA only mentioned connection for L1 from an older MRI I submitted but mentioned no others. Wanting opinions on course of actions and possible avenues to have my injury rated fairly. Specifics. Lumbar MRI disk dehydration lower thorasic spine. Notably L1-L2 and L3-4. Prominent Schmorl node hernia…

Claimed Pulled Out Of Fdc Should I File 5103 Waiver?
Folks: If my first ever disability claim was pulled out of the FDC Program and I have submitted all evidence that exists already, should I file a 5103 Waiver to move the claim forward in the process - instead of 90 days for them to look for something that they already have? Ebennifits says they are awaiting 3rd Party VA records but VBMS has them already.

ptsd I Am Rated At 50% And Happy About That But...
I received my rating for hip, back, knee and hearing... and dont get me wrong i appreciate the 50% rating i got right out of the chute first time through. the money is a god send and i feel like less of a sponge off my girlfriend but my question is this... when they rate you for your problems do they really look at you as a person or a collection of problems. all of my issues are service connected... im not looking to get anything i dont deserve but still i wonder when they look at your claim do they see a person or a collection of issues that dont seem "that bad" individually. however when you put them together they make life nearly unbearable. i have a knee that is just…

Need Your Advice On Claim Big Date Change Gathering Evidence
Folks: I filed an informal disability claim a year ago and then the followed (provided the evidence) FDC 6 months with all evidence and 14 DBQ's to the Regional Office. Both are one and the same so- Informal 12/2014 and the main claim was 6/30/2014. So, In August I filed a FOIA because folks from Hadit.com said to ensure that the C-File had everything in it because of problems on this site idntified with other vets. So, it stayed in "Review" until yesteday (6 months) when I cancelled th FOIA. So today status changed to "gathering evidence" but the expected completion date now changed from 02/16 all of the way to 4/17? (approx 2.5 years) Obviously, cancelling the FOIA had…

ptsd 2 Months Into Meb-> Bi-Polar Changed To Anxiety Disorder (Nos) And Personality Disorder... ..what..?
Hello fellow members, I am new here; however, I felt that I had to write this because I am utterly confused. A year ago I suffered a bad accident on post involving a truck accident, which resulted in minor injury to my shoulder, but a large mental scar. I have trouble functioning daily and wake up from nightmares and have daily flashbacks... I went to a acute treatment facility, referred by the Army, and received a diagnosis of PTSD. My military psychiatrist originally awarded me a BI-POLAR diagnosis... I have no clue why... I argued with him in regards to that, but he kept it. After taking that long ass NEUROPSYCHOLOGICAL TEST, I am now labeled as having ANXIETY DISORDE…
