Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Will C-Foia Request Delay Claim Processing?
Folks: I always appreciated the fine advice that I've been given on this Hadit.com Board. There are a lot of very smart Vets and Spouses that continue to provide excellent advice here. Anyway, last August/2014 after getting some of that advice, I decided to request a copy my C-File because I've heard the numerous stories of missing evidence that has caused denials and subsequent long appeals. So, it been a long battle and I finally received a letter that I could drop by the Regional Office and review my C-file in person? Anyway, today I dropped by to see my VSO to ask why after 6 months my case is still under "review" only and she "scolded" me for submitting a C-File FOI…

Development Letter Not Arrived After 10 Days?
Folks: 10 Days ago Ebenefits alerted me that a Development Letter had been sent to me and after my claim had already sitting in the system with no action for the last 6 months. I started the claim over a year ago and had heard very little from VBA? Anyway, I'm at the 10 day mark and the letter still has not arrived to my mail box yet?...Is this the usual situation for Development Letters being late or should I contact the VBA about still not officially receiving the letter? I believe it's going to tell me that my claim was taken out of the FDC Program because the claim completion date changed in embennefits from 02/15/2015 to 01/15/2017.

Nvlsp (National Veterans Legal Services Program)
Hello everyone, I am new to this site, so I appreciate the time I have to talk with some very knowledgeable people. My first question is: Has anyone had any encounters with NVLSP? If so, was your claim successful? I was contacted last week about a settlement they want to help me with and I am a little skeptical since they contacted me and I had never heard of them. The said they received my claim from the DAV and work on behalf of the veteran through the DAV. All services are pro bono and I have no financial responsibility win or lose. Thanks for any info you can give me. I look forward to hearing some good news.

Discectomy Versus Fusion
About 10 years ago I had discectomy's done on 3 vertebrate (L5, L5, S1). Then five years later as it had gotten worse I had to have a back fusion on the same 3 vertebrate. Didn't really help and it has just gotten worse. I was told that it would probably fall under Traumatic arthritis instead of IVDS? Does one rate less than the other? Was curious if anyone had the same thing done and how it went with the VA and how they rated it. ROM is very limited and painful. I take oxycontin daily as well as Lyrica twice a day for all the nerve damage in both legs.

Understanding Crdp, Ab8, & Taxing
Hello, all! Let me begin by stating how grateful I am for this site and all of you that contribute to it. I've been a "lurker" for many months, but have never posted because I always found an answer to my question by using the Search option. And it wasn't until yesterday that my claim closed and my rating viewable on my AB8. Hopefully now that I am near the end I will be able to contribute more of my experience to this forum in the future. My question is similar to what OKIexpat asked a week ago. So if I could borrow your time for a bit to try for some clarification. I am retired Air Force and left as part of the big force reduction. I completed 16 years and…

Help Needed With What To Claim
Good evening everyone, I am assisting another vet with his claim. Here is a little back ground. This vet was hit by a passenger car while on base when he was in the Marine Core. He suffered many injuries which I will list here shortly. They wanted to medically discharge him at the time but he was able to talk his commander in keeping him in since he was so young and wanted to do so. He was discharged later because his enlistment was up and he wanted out. He did not put a medical claim in until about 8 years later. To make this short he was given ten percent for hearing loss. I will copy and paste his injuries he sustained so you ca…

100% P&t But Receiving $537.97 Only
Hello everyone. I’m new here. I apologize if I posted this question in the wrong forum/thread. I retired 08/31/2013 (eBenefits initiated my claim 9/01/2013 and finally closed 02/11/2015). According to eBenefits I’m 100% P&T. I’m still waiting for the big brown envelope. On AB8 info, my gross benefit amount is $3,198.97. However, my current monthly award is only $537.97. It also states that the effective date of the last change to my current award was December 01, 2014. I have no clue what is the VA or DFAS calculation process. My question is, if my gross benefit amount is $3,198.97, why am I getting only $537.97 monthly and what is the effective date of the…

Who Should We Contact
My husband received his disability rating of 90% in July 2013, he has not received a payment to date. When we visited the VA they stated it was because he selected not to waive his retirement pay which is outdated. He was asked to sign another form and submit it in which he did. We then waited 30 days to inquire again, they said they never received it. He then resubmitted it again certified mail and again waited another 30 days. We then decided to visit the VA in Jackson MS, they couldn't tell us why he wasn't getting paid but again asked him to complete another form. We have since relocated to Texas and have visited the VA twice to see what's going on, nobody can tell us…

ptsd Conditions Left Off Complete Claim Packet--What To Do
Hello. This is a good site. I have been wondering what to do. Can someone help me? Wife and other friends are telling me to appeal (as is my VA doctor from hospital) I retired from Marine Corps last summer. EAS was 31 Aug, eBenefits said claim started Sep 1, and finished Oct 7. Enlisted. I am rated at 100% but the letter says I have to be evaluated again starting Sept 1, 2016. I have mental health appts monthly and take 3 different meds.Ugh. Hate that. haven't w…

ptsd Advice
I will try and make this short. I need advice on what to do. I have a ptsd/mdd claim still in the works since June 2013. I had my left knee replace in 2/14. Since you can only have one claim in at a time the left knee was combined with the ptsd. They are both still in the gathering of evidence phase. The last thing was requesting Service records. I have also completed all C&P Exams. I know ratings can take awhile, but I have just recently had my other knee replaced. I can not work because it is my driving leg. Now money is tight, but I don't feel like I can put in for this knee because it will start everything all over again. I have called my Dav and he chuckles and …
