Reduction: Sleep Apnea
Hello fellow Veterans! I have a question that I need your help with. I was rated 0% in 2002 when I was medically retired under chapter 61 for sleep apnea and 40% for LBP and 30% Asthma. A year later I filed for an increase cause my symptoms came back after my uvulopalatopharyngoplasty surgery on AD, I was award 50% for sleep apnea( on CPAP). Last year I field a calim for my knee, then they told me that they had made an mistake and I could'nt get Asthma and sleep apnea rating! So I found the below information and I wonder if it fits the bill for what I'm going thru? Does the10 year rule apply here? I asked for a hearing, but they been putting me off…

ptsd Cannibus Disorder
The examiner said I did not have PTSD but I have two or more mental disorders cannibus disorder and adjustment disorder with mixed mood and anxiety depression. Will I get a rating even if I smoke cannibus? How will this affect my rating?

100% Temp Disability Rating
Hey everyone I have a question if you can help it would be greatly appreciated. I was awarded 100% temporary last year July and have a future exam date of August 2019. It states on my VA letter not considered perm due to scheduled future exam for reduction. Does that mean that they are automatically going to reduce my rating no matter what? Or they have to do an evaluation to see if I have gotten better, worse or stayed the same? I am bipolar and suffer with depression, insomnia, as well as hear voices, I take prescribed meds but they don't seem to help at all. tdiu Claim Status Keeps Changing
Hi all, I have not been around for awhile. I won SC for PAD non-compensable. So I but in a NOD with my ALSO last October to get compensation. I was called for a C&P, ultra sound on my legs, last Friday. Friday ebenefits showed the claim Prep for Decision and I was requested to fill out VA Form 21-8940 Veterans Application for Increased Compensation Based on Unemployability. Today benefits, today, is back to GOE. Anyone has some input as to what my be going on and why I was asked to fill out the 21-8940? Sincerely, Hugh

I just faxed the following message to my VSR. I am curious what he will reply. My claim for PTSD, dated June 25, 2007 was denied due to lack of proving a stressor. I filed a form 21-4138 (your office filed it) in June 2012, and resubmitted the same medical evidence as was in the 2007 claim along with the complete military logs confirming one of the stressors, and requesting they re-open that claim due to New and Material Evidence.. Instead of reviewing the June 25, 2007 claim, the VA opened a new claim. It is my understanding from New and Material Evidence under 38 CFR 3.156 this request for review should have been addressed. Question About Being Wheel Chair Bound And Back Ratings
i am currently 40 percent for my thoracolumbar spine. last may i had an mri of my lumbar spine (for pain clinic) and as you know showed 5 herniated discs, a grade one vertabrae slip, spinal and foraminal stenosis, 2 torn discs and multi-level arthritis. when i had my ortho c&p in october 2011 for my IU, they used the results of a routine lumbar xray which showed only arthritis and they kept me at 40 percent. i have also been wheel chair bound since 2005 for my back and inflammatory arthritis. i am considering filing for an increase based on the mri findings and (hopefully) a statement from my current primary care doc that i am use an electric wheelchair du…

Aggravation Of Pre-Existing Condition
If you start a claim (service connection due to injury); however realize the claim should be Aggravation of Pre-Existing Condition. Can you change the type of claim during the NOD or the VBA. My left knee (non service connected) was cited for problems during the entrance physical. I had an episode of laxity, soreness, and weakness for three weeks during my military career. Everything is documented in SMR's. I recently had a MRI which diagnosed tendinosis (chronic breakdown of tissues, tendons, fibers etc). Can I change the claim mid stream or do I have to identify the claim as a Aggravation of pre-existing condition in the beginning.

Having A Partial Hyst. In April. What Will This Change?
Hello! I am 34 years old and currently 40% disabled due to various chronic conditions. I am 20% disabled for a prolapsed bladder. I was seen in the VA hospital today and told I require a hysterectomy. (Will probably leave ovaries) to correct a prolapsed uterus and to reconstruct my vaginal walls due to incontinence, pain, bleeding, and inability to have a bowel movement. My question is will this "corrective" surgery cause more issues and if so what are they? Also, how will this affect my disability rating? I have 40% for migraines, 20% for stress incontinence which I had surgery for a bladder sling in 2003 to "correct", but still having issues. Any help or advice is …

ptsd Filed For P & T And Now I Have A Predetermination Letter For Reduction
I am 100% SC PTSD, Panic Disorder with Agoraphobia. Effective date is 02/16/2009. Had my third C & P in December 2014. I have the copy and it is not good again. My VSO told me to file for P & T now since it has been six years with no improvement. My claim for P & T was opened on 12/02/2014 and my C & P was on 10/08/2014. Wife attended with me because of the process plus I do not like crowds. I waited for answer. On 02/09/2015 on E benefits in my open file it said pending decision approval.
