Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Air National Guard Traditional Retired Claim Va Not Counting My Gaurd Time
I spent 10 years active duty, two tours in Iraq and the rest of the remaining 10 years as a traditional ANG guardsman fulltime federal technician. I retired in 2010 question I have several conditions my private doctors/surgeons said directly were caused by my service in the Air Force (recent while I was still in the ANG). On drill weekends and my deployments we are exposed to the same things as any other active duty person. I filed my claim several days prior to my ANG retirement after 20+ years but after two years of waiting for the claim to be decided now the VA says they are only counting my active duty periods from my DD-214's from active duty and my two deploments to…

ptsd Need Some Sound Advice
Hello to all and thanks for the ones who have helped me with advice from the past..(Hoppy). I am in need of some more "bought" advice from the old timers and anyone who has been down this road. This is the situation. I was in the National Guard until 2006 when I was "administratively given a 15 yr letter for retirement". I was granted 70% PTSD in 2006. I was working at a state job before I was deployed, and when I returned I assumed my old job. When i was rated 70% for ptsd, I was sent a tdiu form to fill out. I of course didnt want to quit working,( I kinda felt it was helping me get some normalcy) nor was I laid off or fired from work. I have a super boss, who is ver…

ptsd Should I Apply For I.u
Hello All, I may be eligible for 100 percent disability because I'm over 70 percent disabled and I have been unemployed since Jun of 2011. I started to recieve my compensation this past March. Now here is the drawback. I got fired from my job because I distributed a control 3 substance to a soldier that was not allowed to have it. The only reason I was fired is because I gave the substance inside a military installation. I was not selling it. I'm located in Germany so the laws are somewhat different. I was interviewed by C.I.D. and the case was turned over to the german authorities because I'm a civilian.I was never convicted or had to stand in front of judge. The on…

Parachutist Badge
Maybe another way of getting foot In the door at least for a C&P? http://www.va.gov/vetapp10/files2/1017019.txt The Veteran's personnel records indicate award of the Parachute Badge, and thus there is certainly evidence of participation in parachute exits from an aircraft. The activity of parachuting from an aircraft is, by nature, stressful on the joints of the body. Given that the Veteran has served as a parachutist, his statements of being injured while exiting an aircraft are certainly possible, and his award of the parachute badge gives credibility to his claim.

ptsd Continue New Claims?
Ok, I got a letter from my DAV rep saying they reviewed they the most recent VA decision and i went from 30% PTSD to 100% PTSD. And according to the E Benefits site current progress is: Current Progress Description: Your case has been received at BVA, and BVA has mailed your decision to you (and your representative, if any) and will be returning your claims file to the VA Medical Center. Please note that transit times vary, and there may be some lag time between when BVA forwards your claims file to its appropriate location and when that location receives it. My question is, ebenefits now has 2 new claims that i filed back in June 2012 for TBI and Carpal Tunnel. Sho…

Clothing Allowance
I have a issue that I submited for and recieved my payment. Also, submited for dual allowance. I recieved a call on a saturday telling me that I am being removed from "static" or "status". I'm not sure what this means? Also, can't find a RoC about it. Then I recieved a "BILL", telling me that I was overpayed! I tried to find out why, and was told that "NONE" of my braces/creams qualify! Was told that the VBA put out a new list of what qualifies and what doesn't... But, the ankle(bi-lat), knees(bi-lat) and AFO do not qualify. Ankle braces do qualify except, they have not been inspected yearly to still qualify? And, the knee braces; evn though they have metal rods are de…
