rakk i understand that but thats pretty much what I was expecting i requested a copy of my c-file cause my left knee could possibly require a higher disability well I filed my new claim today and am now thinking maybe I should of done it myself the DAV guy that I normally deal with was not there. I had a dr appt so I dropped of a list of how I wanted it new contentions insomnia with sleep apnea flat feet with hammer toe/ bunions/corns secondary Major Depressive Disorder secondary to my Retro patella pain syndrome all this was written out on the back of a paper I got from the ROI office stating all my RX's I come back everything is written as a new contention plus (PTSD something about fear for my life) was added after I said I dont want to file for PTSD cause I dont know if I can prove my stressor. He said he has inside information and that it will go through.then started asking me about things I dont have ie neuroopathy and diebeties What should i have done? I am thinking as long as I get sleep apnea i will be able to get TDIU and NOD the PTSD and MDD by telling them that DAV talked me into it that I didnt want to file for PTSD My thinking is MDD and PTSD are going off of the same rating criteria and MDD is easier to prove why do both

yes it is a joke unless someone actually wants to give me some dependants at not cost or responsibility to me

when you see claims going on forever and ever they have all been appealed at least once I predict 6-8 months for your claim I am starting a new one today so i am gonna predict a decision by end of oct

Well my envelope confirms what DAV told me. Now show me the money I got a question though since now both knees are service connected at 10% each does that make them bilateral or does it have to say bilateral offically rated at 30% now going to start a new claim today after my dr's appt

What I learned is the DAV get their info from when it goes to rater to SR rater so you can get their letter while still in the decision process the 800# says that notification phase can take up to 40 days mine was friday afternoon till mon morning so hopefully I will have some money in a day or two I should have my envelope tomorrow or wednesday if it went out today

?? Does the va payment noticication on ebeneifits tell you when your retro is paid

just to recap started claim on 6/15/10 for Currently rated 10% bilateral tinnintis bilateral hearing loss right knee secondary to left knee and tried to raise left knee went to decision phase on 9/15/10 Notified by DAV on 3/11/11 told i was now at 30% 3/18/11 ebenefits showed notification phase today 3/21/11 ebenifits says closed letter generator confirms 30% hopefully I will get the back pay this week my unemployment ran out last week and I dont get my first voc rehab check till the 1st

Currently 10%retro patella pain syndrome 0% skin condition 0% for something else According to the DAV these are on the way10% chondromalacia right knee 10% bilateral tinnitus so there is nothing that i am currently SC for that I could blame as secondary I have proof of Insomnia from my final physical and there should be plenty about it in my records since the VA considers Insomnia to be a symptom and not a disability would it be secondary I am pretty much sure that i can get one of my doctors to write up something about my insomnia is caused by my MDD and Sleep Apnea

after doing a little research i think PTSD may be almost impossible to prove a stressor for as it was for training that simulates combat and the only other person that was there is no longer living. I wish i had my entire in service medical records but i dont I have requested my omph and it has my seperation physical. In my physical insomnia, and flat feet and problem with ankel is listed but after a BVA search i found this While the Board notes that insomnia is generally considered a symptom and not a disability capable of service connection, insofar as the RO nonetheless granted service connection the Board is constrained to rate this disability.I want to link insomnia to both sleep apnea and to major depressive disorder since insomnia is a symptom of both. After reading up on all 3 it seems to go hand in hand so how should i write this up :sleep apnea secondary to insomnia and MDD secondary to sleep apnea and insomnia I havnt yet had a sleep study due to missing a appt in oct should I wait and get that done first or since it will be required of the C and P exam go ahead and file as soon as I get my current claim closed also who at the hospital should I call to reschedule a referral to a outside sleep study

wow yall are having to wait for a appointment for x-rays that is crazy my dr just puts the orders in and i go straight to radiology and get them done. I have a question hopefully someone can answer I had a appt for a sleep study in OCT but I missed it and my psychririst has been ordering a new one every time i have a appointment the sleep study is done at a independant office. Is there anyone i can call to get this rescheduled. or since one would be ordered on a c and p exam should i just wait till then

Well one week after getting a notification from the DAV my status on ebenifits has changed to notification. For the last week I only had one letter available in the letter generator and all it tells me is my dates of service

I have tried several numbers today and everytime i get a recording that no one is available or a voicemail message that they are unavailable till march 21.

The DAV service officer told me I should wait untill I get resolution on this claim before starting a new claim. My PTSD is gonna be a tough one I think it comes from training that simulates combat not from actual combat. So I guess I will have to try and track down a witness and have to write a stressor letter. For my NOD I believe that they are igrnoring my arthritis in my left knee as they are just continueing the previous rating. My left knee is has a range of motion of less then 20degrees and by looking at the rating table the way I read it should be 30% maybe higher if I got arthritis added with it

I went to the bussiness office the other day and had them print off a list of all my diagoniss and they have codes out to the side these codes don't seem to correlate to 38cfr. I tried a internet search on one and It wanted me to join a pay site to view the info here is a example TRAUM ARTHROPATHY-L/LEG (716.16) where can i find out about this code and I am about to submit another claim as soon as i get the offical notification that the previous one has been closed . oklahoma now i guess what i needed to do was mouth off a little this morning I cant get on to ebenifits but the mailman wakes me up with a letter from the DAV saying that my 10% for left knee is now a combined 30% for both knees and tinnitus. nothing in bank accont yet. So in a coulple weeks i'll be starting a new claim this time over mental status's
