Go to the download letters section and see if you see a commissary letter. They always offer appeal status because any decision can be appealed.

You need legal help from an experienced attorney who has been thru this before. Also an IMO would be a good idea.
The VA isnt playing games here. They play for keeps.

Congrats Blue vet. Now contact the VA and ask them to refund any CO Pays you made back to your effective date.

The Va makes errors. They not perfect by any means. Now legally you can write a letter to the VA and ask them to waive any over payment if it was done by their hand. They sometimes grant these waivers. If they are pressing you like you say with no official notification, Contact an Attorney who is qualified to practice in Federal Court as you may have to get an injunction against them so this thing can play out in the legal system.
Hang in there.

I actually predicted this.

Actually Buck they can.
The word total or disability causing the vet to receive IU can be conceived as total. Therefore the total plus 60 rule can still get the vet an SMC of S.Look that one up as S is separate from these SMC levels. Notice how the small print leaves s out.

Email Dr Bash at DrBash@doctor.com He just won a claim at the BVA for the exact same issue.

if it were IU the letter would be spacific. No future exams means P and T. You are now entitled to CHapter Education benefits, ChampVA for the family . Waiver of premium of VA life insurance (First 10 K)
The drivers license may be an issue depending on your disability.

Flip after 20 years leaving is not an option. You can really never leave Hadit. You can take absences but it always reverts back because we all have the same mission left in our lives. Hadit is like the Hotel California. You can check in but you can never leave.
All jokes aside Brother I hope all is OK for you and If you need anything, You can contact me at any time.

If I were you I would ask to change your care to the Lexington VA. Their Oncology department doctors are affiliated with the university of Kentucky and the Markey Cancer Center.

This is the story of a 91 year old WWII vet that was discharged from the Army with TB. Over the years the VA low balled, cut him off of his benefits all the while his lungs continued to worsen. He could not hold a job that required a lot of exertion so he held sedentary types of jobs. 3 years ago I visited this Veteran and found out that he was rated at 30 percent for all these years. That didn't sound right. I read his files and he had severe COPD, Heart disease, Pulmonary HTN, Sleep Apnea, He stood up twice, got short of breath, fell, Broke both legs, Injured his back. He is now wheelchair bound and is very ill. He is hanging in there. I reached back into my own claim and took some knowledge I had learned over the years and had to develop a game plan. This plan included getting him a good certified representative and getting a Doctor who was virtually hell on wheels. We chose John Dorle and Craig Bash as the team to handle the claim. They both put in countless hours, Dr Bash even Flew in to examine him 2 times. The claim was denied at the RO level, and the DRO. They appeared to be waiting the Veteran out as time was not on his side. John did a form 9 and got an expedited BVA hearing. John Dorle came to louisville and Dr Bash went to DC and attended the hearing. These 2 folks are a well oiled machine. They had the information, Dr Bash even brought some aids to help explain his point of view.
Today, he received a decision. He won each and every claim issue at the BVA. He should have a very high level of SMC, possibly R2 with a barrel load of retro.
That Veteran is my Grandfather.
Thank you Dr Bash and John Dorle.

The VA scale is always in the rears. If your award date is 11/29 The pay date is 12/1.
There is always a change in december because that is the month the cost of living increase is added. That changes the scale so they put that into your record for each cola adjustment.

Look up the presumption of soundness rules. Also look up BVA cases. Do a search to find a claim that mirrors yours.
That may help you.
