    I’m going to write my hello post, but I wanted to chime in on your post before I lost it. (Newbie!) My first thought was what injury did you get both shoulder ratings for? 
     
    My next thought holds no foundation at this point but is something my Dr. At the Polytrama center are looking at. I was really sick before my TBI. Even ended up in the infectious disease office but nothing could be diagnosed for certain. I was in CA and at one point it was listed as Valley Fever. This was early 90s and until my son found a chunk of medical records and put them in order I had no memory of being so sick before the accident. There are a few articles out about infections being more important to the immune system then injury. That would possibly create issues for a head trauma if you might have been sick at the time.
    Just thought I would share in cause you might remember something.

    Are you retired from the military. Did you serve in a combat zone?

    broncovet, thank you for the advice and information.  I got the info on my decision today by speaking with my VSO (who isn't too helpful).  I was denied service connection for my TBI.  The VA's reasoning for this is that my service records and separation physical (fall 2008) were silent for TBI.  TBI wasn't something there was a lot of awareness on when I was in, so i was naive to my injuries for several years.  I spent 6 years in the infantry from 2002-2008 with 3 combat deployments, I have been exposed to IED blasts (twice within 25 ft), RPG blast within10 ft, and a vehicle rollover in which i was knocked unconscious.  There are service records for my MVA, but they do not discuss TBI as it was from a battalion aide station and TBI wasn't really a thing then.  
    Within weeks of separation I did an initial physical with the VA for my medical coverage and screened positive for TBI and was scheduled for a neuropsych exam in 2009.  Long story short, I struggled with my transition for a few years, and blew off all VA appointments/disability claimes when I first got out.  I got my act together and eventually filed for disability with VA in 2017 and was service connected at 70%, but denied service connection for TBI at that time as well.  
    During my initial appointment with my VA primary care Doc, I again screened positive for TBI and began treatment with the VA polytrauma team.  I took my care more seriously this time around and have been very proactive with my treatment.  I have had an MRI that detected a bleed in my brain and also did the neuropsych exam which I mentioned already.  
    In 2019, I submitted the supplemental claim for TBI that was just denied.  With this I submitted all my VA records, and a lay statement from the person I was sitting next to during the rollover, where we both lost consciousness.  My TBI C&P exam was done in April of 2021 and the DR listed the TBI as service connected.  
    In the decision letter the VA relied on the lack of TBI diagnosis in service and not being mentioned during my separation exam, even though i screened positive a few weeks later with the VA polytrauma team.
    I would appreciate any advice on how to best proceed.

    Occupational,safety and health! People have rights to work in a safe health atmosphere trumps how someone feel.  You don’t like working in a hospital get in different line of work.  You don’t believe is science don’t inter the science of   field study.  No one has the right to endanger other people health

    Well my opinion is if he make them do their jobs and hold them accountable! Being a veteran does not matter! He does not create laws he is there to enforce them and solve problems to get the job done!

    If you had this condition more than 10 years  you  can request they cancel this exam.
    you might let them know your condition has not improved   , and they most likely will cancel this exam.
    Now if you ask for a increase  thats a whole new ball game...they will send you to a C&P for that.
    Sometims going to a C&P Exam is a benefit to the veteran as they may see your condition has got worse  if that's the case  an increase could come ,by a secondary condition that your original condition caused or is related to, now being that your already 100%  that increase needs to be at least 60%  if so then you would be eligible for the SMC.
    But if you got called up for a C&P and you never filed for increase?  and you have had this same condition for ten years  you can request they cancel this exam  because your condition has not improved and you had this rating for ten consecutive years.

    Do you have inservice proof of the event that caused the TBI?

    I think you need to be patient. There are vets here whose claims took many many years, even decades.
    Can you explain this:
    " I just never applied because DAV stated 100 TDIU would be best to drop seizures claim."
    Did you ever apply for TDIU or for seizures?

    My doctor stated I cannot work do to my TBI! I never applied for TBI benefits because I was told they would label my condition under other! I am 100% TDIU T & P since 2002! Will they back pay me from this date of letter or before! My Psychiatrist states he documented this all throughout my records! He wrote this letter back then for something else! I cannot remember!  My VA doctors states he will confirm it again that I cannot work due to TBI! Is this letter strong enough along with VA records! Will I need another exam? 50 depression , 50 sleep apnea, 20 back pain, 10 feet, 0 knees,! Agreed to give me T&P for dropping seizures but was in treatment for seizures like on meds.  DAV lawyer’s Stated to take 100% T&P at the time when I retired! Never had a job since!
