ptsd Sleep Apnea Claim

We have spoke of this topic many times and if you look there is another topic about sleep apnea.If you were not diagnosed with sleep apnea on active duty do not waste your time with the va. Sleep apnea is a very hard issue to get service connected unless you can connect it to any of your disabilties already sc. And if you plan on getting an IMO from a VA doctor good luck the majority of doctors at the VA would not even write you a good day note but it does not mean it can't happen. Your best shot is to see a sleep doctor out of the VA and have him write you an IMO connecting it to any of your sc disbilities. I did it and it worked for me. Good luck on your fight. I do not want you to think that I am being rude I'm just being realistic. -

Carlie is right if you can get a doctor to connect your sleep apnea to any service connected issue you might be able to get it but if not you are going to be in a battle with the VA. Like i have posted before it took me 3 and a half years to get my sleep apnea connected and the only way I was able to get it was because my sleep doctor connected it to my PTSD. -

Not to sound rude but unless you have documentation in your medical records from active duty stating that you had sleep apnea your are in for a battle with the va. It took me 3 1/2 years to finally get my sleep apnea service connected and the only way I was able to get was because my sleep doctor wrote an IMO stating that my SA was being aggravated by the weight I have gained by taken med. for PTSD. Not stating that you can't get it but it is a very hard claim to get service connected. Best of luck. -

I COULD NOT HELP BUT TO READ THIS TOPIC, I DON'T UNDERSTAND WHY VETERANS ARE PAYING SO MUCH MONEY TO A DOCTOR TO SEE THERE MEDICAL RECORDS AND GET AN IMO WHEN I FEEL THAT IF YOU HAVE A GOOD RELATIONSHIP WITH YOUR DOCTOR HE OR SHE WOULD BE ABLE TO WRITE AN IMO FOR YOU AT NO EXTRA COST TO YOU.I CAN UNDERSTAND TRYING TO GET A CONDITION SERVICE CONNECTED BUT SOMETIMES THE VA DOES NOT TAKE IMO INTO CONSIDERATION ESPECIALLY IF IT IS NOT COMING FROM THERE DOCTOR.IM NOT TRYING TO PUT NOBODY DOWN BUT I HATE TO SEE VETERANS WASTE THERE MONEY FOR AN IMO AND NOT GET SERVICE CONNECTED FOR THE CLAIM THEY ARE CLAMING. -

All you have to do is call the texas veterans commision and talk to the people in charge of the hazelwwod act and they will let you know everything you need to know. thats how I found out about this free tuition for dependants. -

first of all you don't need to come down with an attitude about this issue and for your information when I entered into active duty it was from a different state but i moved to texas and joined the national guard and later on I was call up for active duty for which I did almost an entire year in bosnia and because of my activation my familiy qualifies for the free tuition. -

just because you were not born in Texas does not mean you can't get it, if for some reason you were activated to active duty through the national guard your dependants will qualify. -

I am also related to some fine veterans from several conflicts and wars going back quite a few years. I have had the misfortune to run into some very, very bad ones who took advantage of me when I was stunned with shock and grief and then later ill and near destitute due to circumstances beyond my control which adversely impacted my cognitive abilities; I believed these men, many of whom were veterans as I was brought up to respect these men and these organizations by my father who regularly assisted members of a couple of these organizations and spoke at their functions. I trusted these people and neither incompetence nor ignorance is a good enough excuse for any of this. I will tell you that all of these men drew salaries and benefits from state agency and some compensation from the VSOs as well; the lack of compassion and ethics is grossly negligent in of itself exclusive of their breaching their duties to assist and prosecute the claim. This is a valid topic and something that directly concerns other posters here. No one has named any names, individuals or agencies. I am sorry it upsets you, but what was done to my husband and to his family makes MY blood boil, not to mention all the veterans and/or their surviving family members I have met over the many years who got little or no assistance. I am not the only one this has happened to, only someone who refuses to remain silent about it any longer. Hopefully, my speaking up will encourage others to do the same. -

Can we please put and end to this topic and move on, if somebody is not happy with the service provided to them by any organization then I suggest dont use them or get an attorney and see how much they are going to charge you. I am not saying that all organizations are perfect but it is all we have to represent us. Let me tell you about this vietnam veteran he was the commander of a chapter here in Texas, he is a person that I dearly admire and respect being sick he would come to his headquarters and help veterans fill out forms for claims and helpm them write NOD and appeals he did this without asking for a dime just donations like paper and ink. He was one of the few persons that helped me with my claims and he was proud to be a commander for the DAV . So when I hear all these complains it boils my blood and it upsets me because I remeber how this veteran will take his time being sick and help veterans free of charge. I hope that the elder memebers of this site step in and finally put an end to all this. PLEASE -

If you dont like the way they work than dont donate a dime to them they are not putting a gun to you demanding your money. You cant judge an organization based on the mistakes of some memebers of that organization. The DAV in my jurisdiction has been more than wonderful and helpful and yes I am a paid member of this organization and I also have donated money to there cause.In my eyes they have earn ever DIME of donation and memebership fee that I have given. If you decide to sue any of these organization feel free like you said its a free country I wish you luck on your venture. -

Are you a paying memeber of any of these organizations or are they helping you for free.If you are a paying member than I can understand your frustration but if they are representing you for free than I dont see the reason that you want to sue them when you are not paying a dime to the organization. When I worked for the federal goverment I was a member of the union and paid my dues because you will get a better representation from the union being a member than not being. :) -
I tried that buddy letter for my claim and I think sometimes if all comes down to if that rater wants to accept them or not. To get my claim sc I had to have a DR. that was an expert in the field to write me an IMO and that was the only reason I was able to get it service connected. I wish you good luck and I hope that they accept your buddy statement as evidence towards your claim.

Turnning info you get from the internet amounts to garbage to them you need something in writting from your doctor, I did turn info. I got from the internet and it amounted to nothing. I reccomend have a good and straight talk with your doctor and ask if he can help you it worked for me. -

Sorry to have buttin into this topic but if you look closely at the topic in hand it is talking about SMC and that is the reason that I got into it and besides I was asking berta for her opinion because I needed some clarification on in issue. Relax were all here to help each other, maybe one day another vet might find himself in my shoes and the advice given here might help.

Berta I need your help on this one, I was awarded SMC at the L a while ago and because I had two disabilities that added to 50% I was given smc at the L1/2. This month I was awrded 50% for sleep apnea, so I called my DAV rep and asked him if they were going to move me to the next step which would have been the M but his reply was that you can only be moved to the next step only once. I have called the VA and for some reason or another they do not even now the regulations concerning this issue so I just was wondering if you know anything about this. Thank you very much.

I don't now if you read my post but I was able to win my claim for OSA :D after 3 and a half years of denials. My doctor wrote me an IMO free of charge stating that my OSA was being aggravated by my excesive weight caused by my ptad and medications to treat my ptsd. I feel you don't need to pay so much money for an IMO you just need to talk to your doctor and explain to him about the way the VA operates. -
Since I got a new award the VA send me the life insurance form along with a pamphlat as anybody filled out this form and how does the life insurance work with the VA.

I dont think we should blame the VA in whole for this problem I think every RO should be responsible for its delay. My RO of juriasdiction is Waco and they are very good in time prosess, I think the only claim that I had was for my sleep apnea which took about three years of going back and foward including the appeal process. -

I was in the shock of my life, like I had posted before that I finaaly won my claim for sleep apnea 50%, well guess what since I am at smc L1/2 I thought that by winning my claim with the 50% it would had moved me to the next step which would have been M, well to my surprise I spoke to my rep. from the DAV and he informed me that you can only get moved from L to the next step only once so what this means that you can have 10 disabilities rated 50 or 100% but you are only allowed to move to the next step only once. What a bunch of B*********S********. Yours truly WINDY CITY OUT

Just got my award letter from the VA. 50% sleep apnea associated with PTSD.IMO from my sleep doctor stated that PTSD and the medications for PTSD have caused me to gain excessive weight which have aggravated my sleep apnea. Based on my doctors IMO we can grant service connention secondary to PTSD.
