  1. It is never to late to file (it just cost you money is all). I retired in 6/1995 and I filed my first claim with the VA in 7/2015. I kept procrastinating filing. But once I filed I kept after it, yes I made mistakes when I filed but that did not stop me. Long story short I am now 100% P&T, I did not get discouraged (yes frustrated) when they denied me, I would simply submit better evidence and either file an HLR or a new claim.

So never think it's too late to file. Unfortunately (and I try not to dwell on it) I lost thousands of dollars by waiting to file.

So keep filing your claims and asking questions on this site, there is a lot of good information available here if you will ask the questions.

  2. Just as Bronco stated...I have had several decisions where it list "favorable findings" and still not awarded the disability because the VA puts more weight in their unfavorable findings. You may need to get an IMO (which sadly cost you money to obtain) to submit with an NOD or HLR to establish the disability. If you do go that route make sure that it indicates the doctor has reviewed your medical files, the VA looks for that.

  3. Salty I am in Virginia and all I need to do was submit the letter I generated from eBenefits stating I was 100% P&T (it was unsigned). It took them a week to approve it, they sent me a letter to send to my mortgage company to get the property tax stopped from coming out of my payments. My P&T was actually retro back to August 2018.

Did you call your county tax assessor to ask them? What state do you live in?

  4. For me I see a doctor through Tricare, I applied after seeing her for two months. All I did was submit a copy of her notes when I applied. I saw a VES doctor (she was actually a veterinarian as well as a psychiatrist) and I was given 50% by the VA. I was just honest during my C&P and told her all my issues, it took about 45 minutes.

    But as Bronco states...file now.

  5. I have a back disability and mental health is secondary to the back. I take meds for my depression (I have chronic pain from my back), I see my doc on a regular basis. Yes the meds help, but just because you are on meds and you feel better does not mean you don't suffer from depression. If I would stop the meds and not see a doc then my depression would rear its ugly head again. I am rated at 50% for my depression which I take meds for, which is secondary to my back.

THink of it like this. If you have hypertension and need meds to control it then you still have hypertension, its just under control.

If you have not filed for depression yet then you should.

  6. I guess I am looking at this a little differently. Did a doctor tell you that the car accident made these conditions worse or are you assuming that it did? Is it a coincidence that these disablities started to hurt more after the accident?

Like GB states above you are not a medical professional, let the doctors decide what is what.

Also Should I hear about P&T in this decision?  It does bump me to the 100% club

Shrek when I hit the 100% P&T club I only found out by printing out the letter in eBenefits which indcated I was P&T as of 8/15/2018, I was very happy to discover this fact. The only reference in my decision letter was the part about the educational benefits (which at first I did not realize).

I am confused why the RO needed to send back the remand to the BVA if they agreed with the remand then why send it back. Unless they did  not agree with the BVA? I work for a Federal agency (not the VA) and if we don't agree with the decison (like from the BVA) we appeal it back to them and state our case why we think they are wrong.

For me (it may be different for others) I have always found eBenefits to be reliable with the information posted there.

  8. @GBArmy I will retire at the end of next year.

I believe there is a time limit in which you can apply and receive the $10,000 coverage at no cost.

The time limit is 2 years from the last "New" disability and you must be under 65. I will be 63 next year.  I may apply anyway and let them say no, needless to say I wouldn't take the insurance at $57 a month for $10,000. But will if it is free needless to say.
