Here we go again. All of this hooblah about nexus letter, now vets are financially struggling as is, paying all of their money to get a nexus just to get shot down. I just received a pm from a member stating that legacy appeals are extended for another 3 years. I have not found anything on that but if it is true, then think about how long AMA claims will take. Nexus or not, VA is doing to take advantage of people that have sacrificed their lives for their country. -
I do agree with you. You are one of the examples on the Hadit site that stick with the motto never give up. Just a shame that every time we stay in the fight, the VA continue the battle for a long period.

@Mr cue must say that you know your stuff and keeping your foot on the gas pedal on the VA. I wish that I had the motivation and energy that you have when dealing with the VA. Rewards are coming your way.

This is a tough one to answer. But all of my family has given you great, I mean great advice. All of the same questions will be asked directly towards you so please, a little more detail. The way I understand it that you have claimed in the past but never appealed it. In 2017, your VA team has provided you a nexus letter. Did you appeal or refiled after your nexus within the time frame? If that is the case, then yes I would look for an attorney, if no then you might have to file a supplemental I think.

This is where I was ignorant. I did not file immediately or within the 1 year after service. I guess for 1 my pride, for 2 I didn't know. I was just so happy to get out of the service but at the same time, more worried of how I was going to support my family due to income loss. But by being a member of Hadit for awhile, I have learned a lot. -

Good point @Stayfocus. I think I do fall under this criteria. A slip and fall was mentioned in my c&p exam but it was for a back claim. I had never filed for the neck. The VA is mainly using my vehicle roll over which happened in service for my recent neck and back claim. -
That is great advice. However for me, 160 pounds is far from being overweight in my case. Salt, if I do use salt, it's very minimal. Could it be from the meds that I am taking for my sc conditions? Naw, it couldn't be. Maybe it's age related.

I think that this is one of those hit or miss claims. I do have high blood pressure. When the VA do my vitals, they do see it but have me to wait for a few until it goes down. Nowhere is it annotated that they had did that but they make sure that they annotate the lowest reading. Then they told me just go buy a machine and monitor it. But not annotated in my records.

Even if you had never filed a specific claim ever before but had a diagnosis and an event in service? It goes by the date that you had filed that claim? Now I have to find a nexus even though I had 2 out of the 3 directly after service. -
@Stayfocusoh I gotcha now. I took it the wrong way I guess but now I understand.. it's a shame that we have to go through.

How are we the prisoners? We are not looking at every possible situation to get service connection for what we have done while wearing the uniform. We are looking for Justice.

Also one of my other assumption is that the VA funds ran very low before the new fiscal year. That's why it's so many remands/delays and or denials. After 1 October once the funds get allocated, we might see more movement on claims. Just my assumption.

To tell you the truth, I don't think that anyone can answer that question. People in the same situation are wondering the same thing. As one of our great elders on the Hadit site stated don't sit a wait for a pot of water to boil. My assumption is that the VA system workload is overwhelmed. First, this 20 year war has ended and now lots of vets are filing claims. Second, the VA tried implementing this so called AMA, without at least trying to get a lower number on the legacy appeals. Third, VA is understaffed especially with experienced employees. Fourth, the pact will probably have priority over the AMA basically making no changes for wait times as in the past. Just my assumption.

A thought came into my head and you great people on Hadit may know the answer to this. I had filed a claim for cervical or lumbar strain. I had filed a back condition in the past but I had never appealed the back claim. I do understand that if I did not appeal that claim, that I had lost my eed. I have never filed a claim for my neck. Let's just say that if my cervical or lumbar strain gets granted, since I never filed for my neck, will I get an eed for my neck? Thanks all.

I am appealing cervical and lumbar. In my opinion, I should have been service connected when I had gotten out of the military being that I had an event or injury while in service, had a diagnosis then and now I have multiple diagnosis. We all know that military docs don't write nexus. Now after military I filed for my neck and back, now I need a nexus. I am just so lost on this VA mess.
