Hello again brothers and sisters. I had just received my notice for my c&p exam and thanks to Hadit, I have done my research. Now what I have found out and the info that's on the detailed letter, the fnp only shows the state that the fnp was licensed in, not the state where I live and where the FNP is conducting the exam. Is that legal? I thought that you have to be licensed in the state where you practice. Thanks.

Good to know. However, the VSR or rater did not do anything. I am assuming that they are waiting for my HLR or appeal. -

Wtf is it then? Make me smart. -
Hello all of my brothers and sisters, I recently have filed a claim. I have received an email for scheduling an appointment. Here is the problem, it's with VES. There is only one VES in my town. He is a vet as well. I have had him in the past, I have reported him due to his job performance, I have a feeling that my upcoming appointments are with him. How do I go about getting someone else but him? I will not refuse an exam but I care not to see him. I had a favorable exam for migraines but he came back and re diagnosed me with cluster which caused a denial.

Yes and I was denied and it verbatim quoted what the c&p examiner said. I haven't appealed yet due to the fact that I am trying to get more evidence. It is in my notes from my podiatrist that my severe over pronation from flat feet causes my knees to bow inward causing knee hip and lower back pain. -

I do believe that I had filed this particular claim as a direct service connection to include secondary to service connected disabilities. At that time, the only sc conditions that I had was PTSD pes planus shoulder and tinnitus. Out of the 4 sc conditions, the only one that makes more sense is the pes planus. Maybe I had filed wrong but seems to me, the VA does recognize that I have a knee condition that's related to service. -
This is why that I think that the Vets should be allowed to see what the examiner see on the computer. The VA was supposed to send pertinent info to the examiner.

Opinion. IT is the option that the veteran does have bilateral knee conditions that are less than likely than not proximate due to or result of bilateral Pes planus and bilateral plantar fasciitis. Rationale. The veteran has a specific diagnosis for the left knee as mentioned and the right knee has a dx of recurrent strain. From the history these are related to specific injuries in service and not to the pes planus and Plantar fasciitis. I am not the sharpest tool in the shed and I do understand the less than likely statement means a denial but the MD stated related to injuries while in service. Shouldn't that carry some weight?

I do the same as you do. It did not work on my last claim so that is why it's in an appeal status. As for as being a doctor as mr.cue had mentioned. I am not a doctor but it is in my medical notes as to what the doc had diagnosed. I just submitted a claim last week. 1. Right arm conditions as well as secondary to serviced connected to left arm. Did a support of statement to include notes and page number and x ray from the doc. 2. GERD as well as to secondary for medications I am taking for my sc conditions. Statement for support of claim listed medications that can trigger acid reflux, doctors diagnosis of GERD and how it affects my ability of life. 3. Sinus. Same thing. The only other thing was I added presumptive for burn pit exposure. We will see what will be used to deny that claim but I did point out evidence that I have.

Bronco stated "You "shouldn't" have to do anything. Its the VA's responsibility to figure out whether you have a:." That is a true statement, you shouldn't have to tell anyone how to do their job. That's called micro management. But you must expect what you inspect. That's one of the problems that we have in today's fast paced society. People wants money, but will do a half a job but still expect to be paid. Go clean MC Donald's bathroom. I am not telling you how to do your job. Now if that's a job you don't wanna do, you may half a that job. Of course I am going to check. If it's not right, do it again. How does this relates to VA claim. Well, let's think about this. Over worked and heavy work loads. The mission is to get claims out. Now who is inspecting the work? Should be team leaders and supervisors. If that was was happening, then their shouldn't be so many appeals that are later granted. so with that being said, even though the VA should consider, I usually claim direct service connection to include secondary to or by aggravation. I include a support of claim to back it up. Of course I have my supporting documents such as nexus letters, ime and VA doctors notes. I am not micro managing, just giving them the necessary tools. Now if I get denied which I do, then later on down the road get granted, the vro from the initial claim should be reprimanded.

I was going through my healthevet doctors notes. You would be amazed on how my notes are all jacked up. Has my correct SSN, but my age is wrong as well as my diagnosis. This is probably some of the reasons that I am getting denied. Supposedly I am 76 years old. Far from that. I weigh 275, far from that. The only thing that was accurate as to the reason for the doctors visit that day. I think that this is another way that we are getting screwed. Check and double check your VA Doctors notes.

That doesn't make any sense at all. Too long. Is it a single or multiple appeals? If it's a single one which really shouldn't matter, seems like BVA try to knock that out very quickly, however if it's multiple, they probably take their sweet little time.

Not going to happen. DEERS is very strict on that piece. Produce a marriage license. Not a common law.

Great info Broken. I claimed knee conditions secondary to pes planus. I guess that the examiner found it to be direct instead of secondary. She did put in the note, is due to an injury while in service. -

Whodat replied to Whodat's question in VA Disability Claims Research
The appointment is actually with my Ortho doc. The bad thing is that he is a VA Ortho and VA docs do not like to write a nexus. I even tried asking him by myhealthevet message if my knee pain is as least as likely as not my knee pain is caused by my flat feet. He said that he will discuss that the day that I have my appointment. -

Whodat replied to Whodat's question in VA Disability Claims Research
This is actually going to be an appeal. I was denied knee secondary to pes planus. The examiner stated that my left knee is less that likely due to my Pes Planus because of a specific diagnosis and my right knee is as less as likely due to pes planus, more likely due to an injury or event while in the military. I am going to fight this one. -

Thanks Vync. I have asked in the past and all said no. I was thinking that if I prepare one, they may sign it. -
I have a future appointment with my podiatrist. Being that doctors are so busy they will not write a nexus letter. I am writing one and is pretty much done. I hope that he will read and sign. Where I am stuck is medical studies. Is there a up to date site for medical studies for flat feet causes knee pain? Google isn't friendly, I am getting old studies. Help me brothers and sisters.
