  1. Yes you are right. I have an active appeal open right now. Hopefully that will put me there. I have filed for other things like knees migraines but denied of course so I am going to appeal those as well.
  2. Thanks GB. Actually I am at 89 which rounded me up to 90. I did the math and I only need 40 to get me into the 100 percent club.
  3. Pacman is absolutely correct. And like all of us say, never refuse an exam. I am sure that the VA will want an updated exam although you had already had that same multiple times for the same thing but this is where the incompetence of the exam can come into play.
  4. Thanks for asking, I am at 70 on mental health. I am going to leave that one alone. My ratings are: 70 PTSD 50 Pes Planus/Plantar Fasciitis 20 shoulder Tendonitis 10 tinnitus
  5. Thanks GB. I understand and agree about the nexus situation. I guess what I am not getting that I am currently working with a specialist through the VA, they do recognize the symptoms but will not document it. Now it appears that I have to use an outside source and start all over. I am not money chasing but seems to me that the VA knows that a vet will not quit. Now people like brokensoldier workload is getting larger.
  6. Sitting in my lazyboy, just researching because can't do too much because of my pain. Let's see how I can communicate this effectively. I am service connected for Pes planus and Plantar fasciitis at 50%. Doing my research, this disability can cause other disabilities such as knees and back problems which I do have both with a diagnosis. As far as my back condition, it is currently on appeal as it has been since 2017. I had filed for direct service connection for knees and back and was denied. If the VAMC recognizes that I have DDD/spondylosis and knee tendonitis, even though I did not file it as a secondary claim, if the medical professionals know that flat feet can cause these conditions, why wouldn't the VA consider it as a secondary condition? Why should I have to go back and re file to include secondary?
  7. Sounds like to but correct me if I am wrong, but the RAMP started around mid 2017. You had to elect to go into ramp. Feb 2019 is when the AMA went into full effect. I bet you still fall under the Legacy system.
  8. I do understand that there may be some incompetent Reps at your location. My opinion, first try your local VAMC and look for either a Dav, VFW, etc to help you. It's free. Explain that you are filing for an increase for your sc conditions as well as secondaries if you have evidence and supporting documents. IE, you are serviced connected for your back and later on down the road, you have been diagnosed with sciatica. You can also submit a claim on VA. Gov, if you have registered for it. If not, register. You can and most vets have submitted their initial claim alone. It's when some of get denied and need little more help. Keep getting treatment from your primary care. What I do see is vets file a claim but never seek treatment or have a continuity of treatment. That's a good recipe for denial.
  9. You are correct. 10 is the max. Was I was explaining it that once I had gotten out of the military, all I had gotten was 10% and it was for tinnitus.

  11. Funny you say that blah. Did as well. All I got was ten for tinnitus and 0 for flatfeet.
  12. Agree. However, by reading in vet apps and as well as myself, most did not file a claim within one year after separation. So proving as to why not may be a challenge which could lead to a denial. The reason I did not file within that year because of financial support for my family and I. So I immediately went to work to balance of wages. If I would have filed within that year, more VA appointments and no job due to appointments. But that excuse may not fly.
  13. For some reason I do agree with Mr. Cue. I do not believe it will cause more financial issues for the government. Furthermore, it would put more workload on the already missed VA claims deadlines. If this was to pass, vets would have to file a claim for it. Not automatic. Not trying to be negative at all but if it does, it probably would take years, maybe decades to implement. It would be nice if it would happen.
  14. When I applied for my crsc, I did not have a lawyer. I did provided that I one served in a combat zone. 2 I did have a serviced connected disability that was related to combat which was rated at 50 and was annotated on my disability rating sheet as combat related with a 50 percent rating. 3 i applied within the time period of 6 years after service. I was approved without an attorney. Is your sc conditions combat related and is it annotated on your ratings ie PTSD combat related 50 percent?

  16. Well, I do think that it would say it on your dd 214. Take a look at your 214. Also Google csrc and crdp requirements. May help you. Also I think this is a place on Hadit that explains it better than I can. You are on the right track. It's not automatic, you have to apply for it.
  17. I am sure that my elders will chime in but you are must qualify for either crsc or cdrp. If you are a combat vet, you will fall under crsc. There is a downloadable form . I can attach the form but I do not know if you are a combat vet. Don't want to send the wrong form.
  18. Migraines are tough to get for some people but not all. Don't give up. Keep fighting. I had filed for migraines direct service connection and secondary for my serviced connected disabilities such as tinnitus and PTSD. I am diagnosed with migraines and take meds for it. The first denial was tinnitus does not cause migraines. I agree but tinnitus can trigger migraines as well as PTSD. Got a DTA had another exam and the NP stated that I did not have migraines, I have cluster headaches and the less likely that tinnitus or PTSD doesn't cause migraines. I never said that it did but it does trigger them. Denied again. As one of our elders on Hadit stated, claim headaches and let the VA do the leg work. I think that the reason I was shot down is because I claimed migraines instead of claiming headaches. I even had a head ct scan which the report stated that what was found could be the cause of my headaches.

  20. Good info and advice. I am glad that things had worked out positive for you. However, it doesn't work that way for everyone. In my opinion, I think that the vet should be able to view what the examiner see as well as what the examiner types. Don't work that way for me. Now I have to request cfile and wait.
  21. I do see your point. People see things differently. I do understand the game that is being played. VA knows or should I say that the RO knows that if they order a new exam, it might be unfavorable. That's the exam that they will use. But here is the problem, the examiner says they have reviewed the vets smr and filed. Bold face lie. Isn't past c&p exams are in the medical records? If it's and outsourced contractor, how could they review smr if the VA don't send all records. But they stated that they have reviewed it.
  22. It's all a good point and I have learned a lot from this thread. Dustoff stated that how can you prove it. My question is once you have a c&p exam that's favorable, who does the ordering for a new exam and why? I was in that situation? Also when a claim is filed with strong evidence, who makes the decision of a DTA? I am assuming VARO so this is why I appealed this time. The VA sent me a roadmap on what I needed to do, I did, first a DTA followed by a new exam with the same examiner.
  23. And to add to @Vyncand @pacmanx1check your "myhealthevet", for all of the visits to the VA, they do post the drs notes on there.
