How I Remanded My Claim And Won

In 1996 a Presidential Election year I was close to the end of my rope. Al thought I had been awarded Social Security and was 70% Service Connected I had been fighting my claim for over 5 years.It was sitting waiting for the BVA to take action.

I got busy. I wrote an email to President Clinton and asked for help on my claim. I called the BVA and requested a Hearing which is the right of all Veterans at any time during the claims process. Little did I know but these two actions set in motion a speedy resolution.

The VARO in Waco called me and asked if I would be willing to come to a hearing in about 8 days and I agreed. At the Hearing I signed paperwork for TDIU and agreed that if I got 100% I would quit appealing.

At the Hearing the Officer said that I had been untreated unfairly and that I would probably be awarded 100% but he needed to check on one or two things and he would let me know in 3 days. True to his word he called me back earlier than he promised and told me I had been awarded 100% P&T.

When I got copies of my C&P file I saw a copy of a letter from Presidents Clinton personal assistant asking VA to move my claim and report back what the decision was.

All I know is from dead in the water I had the machinery moving and a decision in less than 2 weeks. Think about that. This is not an opinion it is my personal experience.

Veterans deserve real choice for their health care.

I think the politicians can help us, but they just don't want to help. Most talk a good game at election time and then forget about us in favor of those who have the big bucks. I almost choke everytime I see the VFW and Al caps at the GWB press conferences.

I went and spoke to my senator's (Patty Murray) aide for veteran affairs in SW Washington today. She told me that because of my Senator's great empathy for me they'd be able to tell me what the status of my case was two weeks ago, in two weeks.

No, I'm not kidding.

I'm hoping the whole thing wasn't just a very painful waste of time.

Pete, I have to agree my claim was messed up in Dec 2004 I wrote President Bush they cancelled my DRO on 5 jan 2005 and changed it to an "informal meeting" they had my letter to Bush, they indictaed if I agreed to my heart disease and PTSD at 100% I would drop the other issues, I signed the agreement in May I got the award letter they reneged and gave me 50% PTSD and denied the heart claim I appealed it again then got mad and wrote Sen Craig and VP Cheney the VA in DC got caught lying to Craig in Oct 05 in Apr 06 they awarded the PTSD 100% and still denied the heart disease, so that is still on appeal I filed the heart disease claim in Dec 2002 the PTSD claim wasn't filed until Dec 03 so with my history I still need the Heart Disease SC so we are still going at it, yes after a couple of years of being screwed around writing the White House usually gets them off the stick FYI a congress/senator the VARO has a 60 day window for replies White House inquiries have a 10 day window one of Senator Murrays staffers called me on Wednesday about my claim's mess with the VA so it could get interesting again

Sen Murray has been friendly to Veterans.

The lady I met was very intelligent, warm, friendly and had obviously heard this all before.

I'm just so frustrated at this point. Sorry if I appeared to be picking on the Senator in particular. I just can't figure out who in the world "wins" in this current system.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
