If this is not adversarial then I don't know what is. Who says the VA just rules on the evidence? They cheat,lie and misrepresent the facts when it suits them. John, This is exactly what they did. When it was all said and done you could see the plan. The DRO knew of the retro, if I won, so he lied, sent me to the BVA when I was scheduled for my first C&P. I filed in 2001 and they took so long to deny me for service connection for anxiety with depression, instead they sent me a NSC Pension. When I turned in the New Evidence, I filed a NOD on the 2001 denial, but still had pleny of time for new evidence. I tured this evidence in to the VA in March 2004. Went into the Appeals June 2004. Received that SOC October 7, 2004. Denied for anxiety with depression, Form - 9 for an appeal. He re-opened my claim then for an " Acquired Psychiaric Disorder, due to the " new and material evidence and sent me a letter of the upcoming C&P. This was all in one letter. He had the " new evidence when he denied me for anxiety and sent me off the the BVA and it has been a fight of deceit every since. When the first C&P came back, " More Likely than Not". then they had to come up with another plan. Just overlook that first C&P and sent me for another 5 months later before those two lying quacks. Fight again. The BVA didn't do much better, they make sure that Dr. Muller would stay hidden in the files also and ask me to prove a dumb home loan. I spent almost two years in the AMC due to trash can 13 and like to have never got those personnel records to them requested in the remand. The third time was a charm, for I didn't fax them. Senator Warner did. By this time the AMC called me to tell me the personnel records were lost in the Archives and they couldn't accept my copy. Said they would have to get permission from the BVA to use the copy Senator Warner faxed for me. Those personnel records are not lost in the archives. The Supervisor hid them and told me if I ever needed them again, this is where they are. I know where they are . After all of this, the archives knew the game they were playing also. The last straw was the SSOC from the AMC. when the claims examiner called me at home and advised me to waiver my 60 days for new evidence. I told her then, I did not have my copy. She talked me into it. She had won again. When the SSOC arrived, all the post medical records, the doctors were alleged to have treated me. This is when I contacted Dr. Crowley and sent a letter to the Judge, also by way of Senator Warner. He waited for the IME and the new Attorney and the Judge read my file piece by piece and saw that everything I was saying actually happened. All of this and as it turned out: It is the Board's decision that the Physicians of Dr. Payne, Dr. Crowley , and Dr. Muller gave the Board the TRUE picture of my history and medical conditon. HadIt.com Elder Josephine Posted March 15, 2008 Author HadIt.com Elder Share Posted March 15, 2008 Betty, I am so happy for you man that is a lot of money and to think how different your life would have been if they had been paying it the entire time instead of getting a large chunk now think how many vets and their families are cheated out of it because they won't keep up the fight the VA beats to many vets to death with paperwork and frustration you really do have some fortitude I have only been fighting them since 2002 I am a rookie compared to you lol CONGRATS Testvet, Boy everyone on this site won this award. It has been a long struggle for me and everyone. I remember seeing your name on my post. What bothers me so much there are so many out there, who are not as strong as me. They fear coming to a site like this and telling the truth of their story. I knew in order for the members to help me, they had to know everything and every detail of what happen to me in service and what the VA was doing to deny me. I have been blessed in many ways, for I have always had a husband to care for me and buy me a home and the things in life that I wanted and needed. He always provided me with private insurance and the means to fight them. Most veterans are men, so who is going to support them and feed their children. If there is anyone out there, that I can help, who does not wish to post their story, send me a personal message and I will be right there. I always rattle on too much. I am so sorry. You filed your 'Original VA Claim' 'within one year of military discharge' and the VA denied this claim for some 40 plus years AND hid the medical evidence that would have proved your claim in the first instance ??? Holy Crap,,, I am so glad you finally beat them!! ~Wings Wings, In order to receive my early discharge I had to bargain myself out with being told that I would be giving up my G.I Benefits. I believed this story, for it was so pounded in my head. I was discharged in 1964 and my husband kept telling me it was all a lie, but hard headed me was fearful of the VA and it wasn't until I told my story to a realtor and he also did not believe I had given away anything. This was in 1978 some 14 years after discharge. I walked in to the R. O and did just as he told me I filed for everything I could file for. I even filed for a home loan eligibility paper. I didn't even know I was approved for that home loan until many years later. I did receive a small short note from the counselor at that R.O within 30 days that I was not service connected. I was certain, well, Indeed I had given up my G. I Benefits. It was in 1987, when we were looking to purchase our second home, I received a call from the contractor, " why not use your home eligibility instead of my husbands, also a Vietnam Vet. " In 1987, I used the home loan. Yes, the VA hid my medical papers and the works from me. I was always told they never existed. It wasn't until 2004, I wrote to the archives and there they all were. Since that day, it has been a fight of how to get rid of me, because of the retro pay. They knew they would have to at least pay me back to 1978 if this claim was ever approved. I am sure that is why the VA awarded me the NSC Pension with at least unemployable to 1983, to get rid of me, knowing that I would never be able to collect a dime of the money.
