Bva's Mail Debacle

Well I have seen a lot since January 2005, but never thought I would have the problem of convincing the Board of Veteran Appeals that I never received a mailed copy of their decision. Have repeatedly informed BVA of non receipt on at least four occasions. They assured me that they sent it to my Post Office Box...even read the correct number back to me, correct city, state, and zip code...of course the BVA cannot prove they sent it and for that matter they cannot confirm I received the decision ( which I did not). It will be 17 days from June 18, 2008 to Saturday Joly 5, 2008. Sent the decison via regular first class mail.

They did agree to send a second copy on June 29, 2008. To date second copy has not been received (and the first copy must be lost, stolen, destroyed or heavens, perhaps they never sent it? Tell me it ain't so oh great Secretay of the Department Of Veterans' Affairs....General Peake.

I have invoked great guns to blast them from their reticent actions to include invoking the rath of God, little Ole Me, My Counsel, and even my Congressman.....The mighty winds of the VA blew us all off. Then again who do I think I am >>>>after all they failded even to yet respond to a United States Congressman!

rthomass, I wonder this question too, do they send these particular decisions certified or FedEx? And as far as the Congressman, Senator, or Rep. just useless. I even had one congressman deliver paper work. Just to have the VA butter coat it and sent they exact reply. The VA stated it as if we are on it we just awarded Mr.XXX 40% his disabilities when in fact I had been 40% for the same injury for 13y. The VA are sharp, buddy they make you look like a cry baby just ever thing is so simple and its a misunderstanding on my part. made me just look like an a-hole the way the VA crafts them letters back to the bureaucrats....Then they write you then get that reply, blah, blah, blah. Just an empty letter other than having them request a copy of my c-file. Other than that they have no influences what so ever over your claim..

Rob, Who are you using as a Veterans Rep? They may have it. If they did more for Vets instead of going convention hopping it would work out better.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Ron - maybe instead of a jackass they used a chicken and somewhere along your mail route there was a very hungry dog who ate the chicken!!!!! Then he had the mail for desert!!!!!!hahahahahaha

Well Ricky if the Dog ate the chicken and had the letter for desert he well have some feathers to show for it.

Seriously in accordance with 38 USC Sec. 7104 © (2) (e) "(1) After reaching a decision on a case, the Board shall promply mail a copy of its written decision to the claimant at the last know address of the claimant.

(2) If the claimant has an authorized representative , the Board Shall....

(A) mail a copy of its written decision to the authorizes representative; or

(:rolleyes: send a copy of its written decision to the the authorized representative by any means reasonably likely to provide the authorized representative with a copy of the decision within the same time a copy would be expected to reach the authorized representative if sent by first class mail.

Neither I or my counsel have received a copy of stated decision. Decision was alledgedly mailed June 18. 2008. Well as I said the one way to tell if you have roaches is turn on the kitchen light.....so I going to take my trusty picket sign to the Ole Regional Office today and turn the lights on!

Rob,

What finally worked for me after 9 years is I got smart & got a Lawyer.

Some Vets don't like Lawyers as they get 20% of back pay.

But, isn't 80% of back pay & a check each month worth 20 %?

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
