Impossible To Fix.

I sent an IRIS email inquiring status of my claim, because:

...An April 08 VARO decision says IU was denied.

...An Aug 08 VARO decision says IU was pending.

It did not make sense to me that, it was denied then pending 4 months later, when I had not re applied for IU.

So, of course, IRIS "straightened" it out right? No. Its worse. They said my IU claim was

"claimed January 2007, but then CLOSED July 2, 2007".

The VARO has NO IDEA whether my claim is pending, in appeal, denied, or shredded. I know some of my evidence has been shredded, but now I am thinking the entire claim was shredded, and they were reading from what it stated online.

Does anyone have any idea of how to fix this mess? Oh, yes, I have a VSO, and he is even more confused than I am, and I am WAY, WAY more on top of this than the VARO, in part, because this affects MY paycheck, not theirs. They KNOW when their payday is, and how much it will be, but they dont have a clue on my claim.

Broncovet, how far are you from the RO.

Call your VSO and tell him you are headed there.

Rrequest a copy of the Claims folder and then request thru the VSO an appointment to sit down and go over the entire file.

This will sort it out for you. Take several statements in support of claim forms with you and a good working pen.

For each issue you find write it on the spot in duplicate of have the VSO copy it and turn it in.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Two ways to handle this...

First is call your Congressman/Senator and have them figure out what the mess entails. You'll have to write a detailed letter to describe your situation.

OR

Second, either call the National office of your VSO, and if they can't decipher this, then drop your VSO, and contact an attorney to handle this.

Personally speaking, I'm finding the quality of the VSOs' as substandard. A lot of them are overworked, understaffed and not detailed as they used to be.

The times they are a changing.

As long as you have good evidence your claim can be fixed. It is just getting someone to look at it and read it. I would look at my C-File and find out what is happening. You probably have to write a letter to your RO to see your file. Where has it been since August? That is five months ago.

I have revoked so many POA's I can't count anymore just make sure you have a valid NOD on file and if you don't I would be asking about if they shredded it and file a new one under the program set up due to the shredding mess, they are supposed to allow vets to refile papers they know they sent in but the VA can't find any more, I take my forms to the Regional office and always get date stamped copies back but I only live 10 minutes away so it's easy for me aggravating for the regional office though, they hate to see me walk in the door, I hired a lawyer last year and she is fantastic and I don't stress it any more, and she doesn't take any BS off of them either. I wnat her to make as much money as she can, the deal is VA lawyers get 20% of the award which is better than Social Security lawyers as they can get 25% but they are capped at 5300 VA lawyers are not capped but after 7 years I hope she makes a lot of money trust me 80% of something is better than 100% of nothing

Check with your VSO and see if he has a copy in thier office file!

Do like jbasser said and go with your VSO to completely review your C-file. This will tell the whole story.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
