Is there any specific topic anyone would like discussed on tonight's show?

I just got an email from Jim --

he's had problems with this guy before and

tonight the azz tried to corner him and he says he just

wasn't going to let that happen.

Jim's OK - but may not come back to SVR now.

I am the "newbie" attorney. I was on the Chat line listening, and saw the comments from you and Berta, but I could not figure out how to join the Chat. So, my apologies for appearing "rude" to all of you who offered me greetings. My "rudeness" was not intentional. I had to drop off at 4PM my Calif. time to go to a "day job" meeting. I will try to listen to the full program via archive.

I saw you there Randyhol. I know it takes a little while to figure it out, but after you figure it out it is easy. I had to leave in the last 30 minutes to pick up a Vet VSO call. It will be different for next week. Hope you will keep coming back even if there were a few things out of place on the show tonight.

i missed the show last night, but i did receive this email from jim, who has ok'd it for publishing. i hope this is not a direction the svr radio show is going in, i just can't see that being a productive way to reach and help veterans.

Below email from jim

"I'm beyond irritated. I'm not angry, I'm very disappointed.

I had assumed that the SVR program on Stardust was designed to

broadcast relevant information to veterans who need to hear the truth

about VA compensation benefits.

Believing that, I agreed to give freely of my time. I believe I have

some modest experience and knowledge that is of value to many of my

brothers and sisters.

When I heard that we had a caller who wanted to debate about the 5301

issue, I made it very clear that I would not participate with that

caller. The "5301 Club" is well known to me. Some of the members have

flamed my email to a point that I have set up permanent blocks so that

they can't bother me.

They wish for me to agree with them and use my position as an advocate

to further their cause. I don't agree with their methods nor their

interpretation of the 5301 statute. That puts me in good company as

there are courts across America who also disagree with their views.

Their goal seems to be to have courts declare ex-spouses out of luck

for court ordered alimony and child support. I disagree with that on

principle. I paid painful payments for a lot of years without any of

the whining I hear on the Internet. It wasn't fun, I manned up and

took care of my business. I survived.

The 5301 issue affects a small percentage of veterans. I purposely

design my work to reach out to common issues of the majority of

veterans. I have no dog in their fight and I don't give it more

attention than it deserves.

Having made it clear at the break that I would not participate with

the caller, I assumed we could move ahead to a program of reason and

education of our listeners. I id so and was chatting happily away when

I was stunned that I was rudely interrupted and the program director

forced the caller onto me. I had said I wouldn't go there and I stood

by that as a man of my word. I disconnected.

That behavior was as unprofessional as any I've experienced recently.

I was an invited guest and if there were misgivings about my desire to

not take a caller on, my choice should have stood and debated off air.

The caller got just what he'd hoped for...that caller wasn't seeking

rational debate or serious answers. The program was disrupted.

Veterans who had listened to learn and gain knowledge were cheated of

that opportunity.

That the SVR program has made a choice to become more like the Jerry

Springer show than a C-Span program is sad. But, it's the manager's

program, he can do with it as he wishes.

However, that sort of free for all isn't my style. I won't be

participating in that again. I know when I've been set up.

Do me once, shame on you. Twice...shame on me.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

The stories can be harrowing to read; they were challenging to live. Remember that each story taught me something I would need once I found my purpose, and my purpose was and is HadIt.com Veterans.

We had an incident last night (which the show's tape will reveal as well as the chat room text)

I was urged to keep this discussion going by Stardust via my headphones off the air-until it went downhill--Stardust was unaware this happened on one of my past show's with Jim-same callers-and I believe Jeff cut them off right away-but they kept calling in last night-

I am 1,000 miles away from the Stardust radio phone and cannot disconnect anyone from the radio show.

Stardust (Jeff) is unaware of the long anomosity that these vets (Simes and Berry)have caused in the veterans community.

Jim Strickland,after this incident-decided to blame me for allowing this to occur.

But I refuse to participate in pissing contests and I refuse to accept his bitter emails of allegations regarding me-

Again he was absolutely correct in what he said to these vets on the air-

They have been told this same information-time after time

(PS THANK YOU CARLIE-for typing the law on all that- this issue is not even appropriate for the SVR broadcast-Jere Berry has griped on the net ad finitum for years about a civil state law that we cannot change at SVR.He has his own show anyhow to gripe on about it )

I told Jim last night that if this email he sent to me also-was posted here at hadit today -I would leave hadit.

Because I believe that DIRTY underwear should be WASHED and not be presented to other web sites that are really not involved in the situation.

What I mean is Problems have solutions-and censorship often gets to be a fine line-

This email to hadit is Jim Strickland's way of continuing blaming me for the incident last night.

He accused me of setting him up and I certainly did not do that.

Hadit will certainly survive without my posts -there is a wealth of knowledgable people here.

I will sure continue to use the hadit search feature ,and read the posts from time to time- but will not participate in the discussions.

This was a SVR situation -it CAN be fixed-and he should not have brought it to hadit in this way. Then again he wanted a blame target last night and I guess he thought I would accept being one.

He is quite wrong about that.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
