Question

I finally completed my C&P's this week! and I feel I did well if it was a test. I had a nero Dr check me out and even suggested I file for IU and the second Doc suggested I keep going to my Psycho therapy so it sounds like they were good through C&P's they didn't cut corners of dodge measurements and guessing like the others. I don't want t5o be naive and think it will be smooth but I do feel I am rounding the third and heading for home. Thank you Tbird, you have saved me and my family and thank those of you I have gotten to know and hope to keep the friends I have made over the last couple of years here Jbasser, Hoppy, John999, Pete53, LarryJ and shane for helping me put the pieces in order and Betty, Wings, Carlie, poolguy for sure and some others. I think the worst part is over as I am now waiting for the verdict and am sure it will be in my favor with out a doubt. I know this may sound cheezy but I do sincerely want you to know with out you there would be no claim to fight. When I was floored you guys picked me up when I felt I had lost everything and its hard for me to even write this now I feel so indebted to you all I could cry. I just want to say thank you and let you know how much it means to me and my family...Yog

This was quite a group effort. I especially remember all the work that was put into trying to figure out why they did not think you were in combat when you had a letter from your CO explaining everything your unit went thorugh in Somalia. Later to find out that the only way they could cover their butt was to say they had the letter (it was listed on the decision)but do to some confusion nobody read the letter from your CO.

The best thing that was done to this point was done by you. When your primary referred you to psych treatment you did not blow it off and went to the appointmens and now you have good evidence from a treating physician that is new and better than the bogus C&P they said determined that you did not have PTSD when in fact the exam was not even for PTSD.

The best way to win a claim is with medical evidence. The folks here on hadit can only tell you that you need medical evidence. You as the veteran have to go get the evidence and that is what you did.

You probably got some good perspective from hadit that there are .......................

Yes I know what you mean the olny way to win is to kill them with evidence, I mean over and over and getting involved in my claim as well made the difference here. I really can't see where it could go wrong. It is not the same claim they tried to kill, it is stronger and clear my only worry is they may try to give me a new effective date on an "IU" I resubmitted but I appealed the original one and I think they will give me IU back to 1DEC06 not back to my SSD award of the date they considered me disabled of 1NOV05 due to my SC disabilities.We should know for sure around a week of so when I get those C&P's....again it was a group effort like you said but Hadit provided me the group with the knowledge.... Just rembember, Rich, that you are not alone. Many of us have been treated by the VA the way you have been treated. You came back at them with evidence and commitment to fight on using their own system to fact back. This is how you win with evidence and with fighting them using their own tools (a few good IMO's).

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
