Question

Well as some here know I'm a awaiting a decision on my claim and a member I keep in contact with suggested I check on it and have my VSO check in on my claim too and see where there at with it...Well, I called my SO(VFW)a week ago and he said he'd get back with me so I called yesterday to see what was going on and this is what he dropped on me ... "well since you missed your C&P's there going a head and going to rate your claim as is, I did know you missed them (MY C&P's)?.."

This is where I freaked out on this guy (not his fault) I went to BOTH C&P'S!!!!! they are full of SH*T they are trying to skip my C&P's because they are both fully in my favor like you would not believe this is nothing more than a trick to drag my claim out another 2 years this is plane BS period. They VARO tried to screw me and got screwed and this is there way of "accidentally screwing up my claim." Then in 2 years I’ll need more C&P’s because mine are out dated. I faxed him (MY VSO the "VFW") my C&P’s to give to them that they suggested I missed and did not show up for..

This is a fine example yall, if you do not keep up with your claim “YOUR SELF” you can be screwed as easy as that! I was able to obtain a copy of my "PHSYC PTSD" exam and the only way you can get it is by request only! I requested it over 2 weeks ago and still did not receive it. How ever I was able to obtain a copy 2 weeks ago along with my "Nero Exam" and now they know I have it after yesterday and I am not suppose to so they tried to pass it off as I did not attend the exam, brother you can not relax for 1 minute you have to ride this sucker to the end and watch the VARO all the way to the end as well. My VSO called me back and the VARO wanted to thank me for the copies of the exams and they are going to rate part of my claim and send the rest back to the DRO officer, what a great bunch and very helpful that Indy VARO..Brother you go to sleep on them and you are screwed for sure.. good catch Rich! I love it when we can shove their own evidence down their throats!

Now, when you finally win this claim, I want you to use your retro money to MOVE SOUTH!!!! LOL

I hear the Nashville, TN VARO takes pretty decent care of their vets. ;)

Thats the plan if I can manage the Indy RO from trying to screw me. When I wrap it up I'm there!! Rich

I was shocked really, I did think they had any thing more they could do to me. Yes Hoppy your correct they were just going to go over they same ol'crap but write it up as I bailed on them on the C&P's can you believe that, now that takes some big cahonies. Folk the lesson here is you stay in control of your claim! you don't take a break just because you have 2 or more killer c&p's they are still hard at work trying to preserve those bonuses even when it appears you got them follow through and watch your claim till its finished even mistakes do happen however I don't feel that my problem but they do happen, they know me there by name and some by face this was no accident. This is why we say and preach about being proactive in your claim...Yog

So is the was the OIG investigates complaints mostly just to ask the Regional Office to provide an explaination (but not really investigate it themselves?)

Where do you appeal when the regionla office ignores your NOD even after writing the VAOIG about it and the head of the regional office iginores it also? And the VAOIG turns the investigation over tot he regional office and never even akss for proof. And leaves the investigatino wiht the regional office which still does nothing.

I got a Call from my VSO after the VARO got my new C&P's and they wanted to thank me for bring it to there attention so now there going to let the rater rate only my foot instead of the entire claim since I in fact did show up for the C&P's and send it back to DRO when "she" is done rating my foot...Rich

Oh yeah, that faded away some time ago back pay and all and man what a trip that was but yeah SSD bellied up 3 or 4 weeks ago... Rich

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
