Question

I have recently received a rating of 50% from the VA but I have just lost my job due to the company that I worked for went bankrupt and at the time of my c&p I was still working.Will this help me to ask for an increase and claim iu?

you must be 40% for one rating with a combined of 70% to be considered for tdiu.

i have seen 60 get it before but it's not frequent.

Correct 70% combined with one item rated at 40%.

I received TDIU in 1999 with a single 60% rating it , it happens more than you think.

This statement is not 100% truth, A veteran can be rated any percentage and get IU. He/She must be service connected and have a doctor's statement stating that his/her disabilities makes him or her unemployable and give a rational but the veteran must ask for IU, VA most likely will not automatically consider for extra schedular consideration.

It may be rare but it is possible.

( B) It is the established policy of the Department of Veterans Affairs that all veterans who are unable to secure and follow a substantially gainful occupation by reason of service-connected disabilities shall be rated totally disabled. Therefore, rating boards should submit to the Director, Compensation and Pension Service, for extra-schedular consideration all cases of veterans who are unemployable by reason of service-connected disabilities, but who fail to meet the percentage standards set forth in paragraph (a) of this section. The rating board will include a full statement as to the veteran's service-connected disabilities, employment history, educational and vocational attainment and all other factors having a bearing on the issue.

I am not a betting man, but I'll lay odds, that for every 1000 submitted for extra schedular consideration that less that one gets the award. I realize that veterans do get lowballed, but a veteran would have to be on a death bed to get an award of IU under any special consideration ( which only can be granted by the VA in Washington DC) It just does not happen very often. If it did then we would not have so many veterans rated for PTSD and other serious problems out on the street corner begging for handouts.

TEAC is correct, unfortunately, and it shows that the VA, frankly does not follow the regulations which were highlighted in red in the post below. While the regulation states they are required to submit this to the director, in reality, they almost never do what is required by the regulation.

I agree that this is most likely true but my post was just to inform. Some veterans if their claim warrants it may choose to fight VA. I also admitted in my post that being awarded IU and being rated less than the percentage required would be rare.

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

If you feel you cannot work due to your S/C condition, even at 50%, I would go ahead and put in a claim for IU. A claim for IU is the same as a claim for increase.

The VA is more likely to raise your rating instead of considering extra-schedular consideration. In other words if you meet the requirements for IU you also likely meet the requirement for increased rating.

On the TDIU form it ask if you left your last job due to your service connected condition.

Since you left your last job because of BK this will prolong your claim a bit but this can be good since it will give you time to get all your evidence for TDIU submitted to the VA.

Again, I would go ahead and fill out the TDIU form and turn it in if you cannot work due to your S/C disability since this is basically asking for an increase anyway. This will also secure your effective date.

Another thought to keep in mind.

Whether you are unable to work or not of course depends on your disabilities. I wanted to remind you about Social Security Disability which could be an option. Go to the Forum for SS on this site and you will see some info. SS doesn't go by percentage. It goes by if you can or cannot work and looks at all disabiities not just service connected.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
