:excl: :excl: Got a copy of my C&P for depression, This is what the breakdown is. Just wanted to see what your thoughts are on it. Thank you all.

I am currently rated

40-IVDS

40-BLADDER PROBLEMS

10-Tinnitus

10-Gerd

10-Cubital Tunnel

10-Sciatica For a VA total of 80% disabled

Put another claim in for deppression, panic attacks

Multi-Axial Diagnosis

Axis I Major Depressive disorder, chronic, mild, panic disorder withoutagoraphobia.

Axis II None

Axis III See medical records

Axis IV Primary stressors: chronic pain, bladder problems, recent demise of primary relationship

Axis V Gaf=55

Impression: Mr.Willie 74 is a Coast Guard veteren who meets diagnostic criteria for depression and panic disorder. His inability to manage his panic attacks and his lack of motivation and productivity impact his work functioning. He will likely have diffleculties at this time in any regualr work environment where he feels significant stress. His social functioning is also low. He reported that his prior relationship of two years broke up with him becuase of his physical medical problems. This has increased his isolation and concerns about interacting with others. He does enjoy spending time with his brother.

There is no indication the veteren is not competent to manage any award if granted.

Mr. Willie 74 has undergone mental health treatment in the past with some benefits. He had only recently engaged with the ????? veterns affairs medical center. If he does continue to be engaged in mental health care, it is likely that his mood would improve.

Based on the availiable information, it is more likely than not that his depression and panic attacks are cuased or exacerbated by his service connected medical problems..

I have been seeing a phyc for almost a year and then I decided to claim for depression and panic attacks. My past Gaf were 50

and the C&p gaf was 55.

What do you all think? I have applied for IU after my intial disability claim and was denied.

Willie... I was just awarded an increase from 10% to 50% for Major Depressive Disorder (recurring) and Anxiety Disorder with a GAF of 60. I was expecting 30% - this was the VA Facility in Waco Texas. You never know! Good Luck to you.

I had a GAF of 50 and got 70%. My IMO's pointed to 100% but the VA made if very difficult for me back in 2001. I think they have gotten much more liberal in the last ten years.

Thanks for your timely post. I have a C&P exam with a shrink this Wednesday, and I am a nervous wreck as I do no trust any govt medical person at all. But, your post did give me some hope that I will not get totally shafted.

I just finished my C&P this past week. Just remember to be honest and don't hold anything back. If you do hold stuff in they will not get a clear picture of what you suffer with daily. When he asks how you are doing don't say "good" if you really are not. If you are not doing well that morning and are streesed out from worrying about the C&P and couldn't sleep tell him that. And don't be surprised when they throw an odd question or two in. My doc asked me what I thought "don't throw stones if you live in a glass house" meant.

Do I read this right- you are 74 years old?

But this speaks to the fact that VA doesn't consider age a factor in TDIU claims------ (I guess)

And I certainly feel the award should be TDIU.Have you re applied for TDIU?

???? Can you tell us exactly why they denied you TDIU?

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
