I had a C&P 2 months ago for a claim to increase my back condition. i got a letter yesterday saying they denied the claim but also reduced the radiculopathy of my left leg from 40 to 10 %. i filed a NOD today cuz this is bull. The C&P doctor did not even check my back let alone the radiculapothy of my legs he talked to me for 2 minutes and said goodbye wtf, I am so done with fighting the va it is time to throw the towel in. I guess i will have to stay at 90% forever....

how many years were you rated 90%? have you ever applied for IU?

If you are not working you should be 100%. If you get SSD you should be rated at least 100% TDIU. If you went from 40% and still are 90% the VA is just plain screwed up.

If you are working and are 90% than there is not much you can do.

Veterans deserve real choice for their health care.

Hello Kryptos,

PLEASE........stop and calm down. You are here among other Veterans who have also been thru the ringer. That includes me. I have NO rating and NO service connection yet. I am so tired of fighting with these screwballs ,and just like everyone else here we all have our stories of VA troublemakers. THE VA WANTS YOU TO THROW IN THE TOWEL,,,,,,they are counting on it. Do not let them do this to you. There are so many others that are counting on you to fight and get your benefits to where they are suppose to be. People like me are depending on you as your story could be just the thing that me or another Veteran is watching that could cause us to give up or stand and fight. It is just too important not just for yourself but ALL Veterans.

There are others here who have been thru the exact same thing as you and have dug their heels in and said enough is enough and fought and WON. Yes, I know how hard it is. I am going on a 5 year battle with them and still nothing. I have more issues due to chemical exposures than I could even explain at this point. Just due a search on my posts and under Agent Orange , Fort Greely, and IHD, Peripheral Neuropathy , Restricted lung disease. IBD, Pulmonary Hypertension and a Massive heart attack........just for a few. Someone here has been thru as much or more than what you are going thru and you just can't quit. Pete and Commander Bob have offered some thoughts and suggestions for you so try and think this thing out and be patient.

Who is representing you? Maybe you could also post more facts about your status and claim(s) so we could help. TDIU is for those who are not working. The appeals and NODS are there for you to use. Sometimes a VA lawyer is a good idea , just because you won't have to fight or do it alone.

The VA is slow , stupid and moves without any type of sense. I too want to give up but can't ,,,,,,to much is resting on it. I have to remind myself daily and want to remind you that no matter what happens you must .........NEVER GIVE UP. God Bless, C.C.

"Proposal to reduce" was the VARO's response to my husbands request for increase as well.

They did reduce to 0% and kept it at 0% for several months. It was like a slap in the face, we felt like quitting too, but we didn't

After NOD it was eventually restored to original % with back payments for those few months.

There are some raters on a power trip, that want to let you know they are in control of your claim - they are NOT! It doesn't stay in their hands forever, and eventually the higher ups see their abuse of power.

Keep appealing , get your % back (or raised) and hopefully the SOB incompetent rater fired!

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
