Vietnam Vets Still Do Not Know On Ao

My wife volunteers now at a senior living home and came home the other day telling me she met a wife of a retired Colonel (army) boots on ground vietnam vet with PD and DB2 with heart disease and really just hanging on. The wife wants to file before he goes but not sure how.

I am going to give her this web site and one other to help her get this going before he passes. With all these ailments would he be a candidate for a FAST TRACK that I have heard about?

It really is sad to hear about or brothers and sisters from Vietnam that seem to fit this definition over and over!!

I try and tell every vet I know about AO just to help before it gets the best of them.

The VA or Government or AL, VFW really need to get this out in the open more so there is no one left behind!!

I do also and I am shocked at how little they know about the rights they have under presumptive AO regs. The VA only takes care of a minority of deserving vets because they don't want to take care of the other 10,000,000 who never have used the system.

From experience, do not use the Fast Track System. Fast and VA do not go together. Bottom line is the VA just don't give a damn.

Stillhere , Just think of how many got sick and die a slow death, and not knowing why or knowing that this country the "USA" would do this.

I started getting sick early 90's and did not question this great country! Now I got PC, DMII, PN, IHD and a another problem starting to happen.

Now everyday, I question this Country!!!

Even the new Nehmer AO presumptives didnt make much national news.

Along with his claim, he needs to look into CRDP/CRSC info available here under a search.

He obviously gets a retirement pay from VA and this impacts (or vice versa) anything he gets from the Mil, if his claim is awarded.

I suggest that your wife contact the County's Veteran's Service agency if they have one, or the State Division of Veteran's Affairs, or DAV, AL, VVA, etc to find a vet rep who can visit him at this senior center ,if he is too disabled to make an appointment with them to begin the claims process, as well as having her come here to hadit for help.

The first time I contacted my former vet rep in 2003 he said he could come to my home if that was better then the office appointment. They called it "house calls". I think he suggested that because he knew I had livestock to feed.

Or maybe he though I was disabled. They handled vet's claims with 'house calls;' at 2 senior vet homes in this area too.

Actually I was only 25 minutes from his office and went there instead.

The wife needs to get out his DD 214 and anything else the 21-526 calls for.

She will probably only need the DD 214 for the first visit with the vet rep.

Stillhere, what is cool is that your wife knows enough about AO to suggest helping that Vet. The other day I met a Vet at the grocery store and started my speal about "are you receiving the benifits you have earned" and my wife jumped in with the correct information an AO Vet can use. My wife and I have been a team for 43 years.

Two more years of 100% and her DIC will be automatic.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
