Question

After 15 months of zero movement on an initial claim the VA has sent me a 2nd VA form 21-4138 and 21-4142, and a VCAA Notice Response. They are asking for me to send them more information on one of my issues (bulged C-4, C-5, and C-7).

They say they need evidence that it existed from my military service. This is the single issue that I only seen military doctors for and do not have a copy of my service records to prove it. I seen civilian Doctors for the rest of my issues and had these records and sent them in with the claim.

So I guess my question is what should I do? Just send it back in stating I have no evidence that it should be in my service treatment records. Does this mean there actively working my case?

Thank you HADIT for all the advice in advance

Can a event at work (taunting a accepted VA condition) That results in Mental issues that retire a person be of service connection due to constant pain and depression due to pain? Along with mental events brought by constant harrassment?

in my DRO hearing I brought up the fact that people would jump back if I was going to touch them, like shake their hand, they would jump back yell don't touch me... because my arms and hands were so disfigured by chemicals... I had a horrible time, no dates, or going out were not possible when my arms and hands were swollena dn bleeding,, and could not work.... it would take several weeks for the sweeling ot go down and the wounds to stop weeping blood and fluids.. the DRO hearing let me explain the pain and emotionel problems that went with disfiguement, with chemical exposures...

that is just a little of what I brought ot heir attention at the dro hearing. I also had to bring upt he fact that after I was almos thealed, te forced me ot work with more chmicals causing the same health issues to come back... so not only ruined my work life, but left me with a terrbiel social life,, it left me pretty lonely...

Not in appeals, since I got 100%, and some of it was winning an 1151 negligence, which the VA turns out does not give ful benefits if you win 1151 negligence they squirm and legal loophhole you and your family out of many benefits, really crapp nasty bunch running the va benefits, they wil backstab and scre wyou even if you win you lose. Hey, my former employer the USPS put me at a table for injured employees that was unofficially referred to as the table for the " Lame, Lazy, and crazy". I helped other employees file workers compensation claims as well as one for myself to keep from going crazy sitting there all day. Then one day my employer threw me into the briar patch.

If a buddy witnessed an accident you can get an affidavit from him stating the facts.

If you are harassed on the Job you can use the ADA to get help, if you dare.

Excerpt from the 'Declaration of Independence'

We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which, would inevitably interrupt our connections and correspondence. They too have been deaf to the voice of justice and of consanguinity
