Will I Be Being Fired For Not Working Over Time

Question

I had my base doctor write a letter for my work today regarding working overtime. The note says I currently have decreased physical endurance. Patient is physically unable to work more than the basic 40 hours. Please exempt him from overtime work. Also please take these remarks under due consideration.

My job has stated everyone is required to put in 3 hours of over time work this weekend, otherwise they will assign mandatory overtime on Monday. It is very difficult to work the current hours let alone the overtime hours. The current disabilities I have that I am rated for plus some new ones are causing a lot of pain-thus pain killer pills.

Now I am concerned that they may fire me. Keep in my I also am under a workman compensation claim that is open that I am being treated for-neck and back pain. My base doctor wrote the note. Keep in my the neurological Doctor that was supposed to be treating me canceled that last 3 appointments-no treatment for the pain. He has been fired by me and I just receive an referral for a new doctor at a different hospital.

I guess it really depends on whom you work for.

My last few years in the USPS I was limited to eight hours per day, no non-scheduled days, no overtime.

They didn't like it but that's not my problem.

Sorry to hear you have job worries added to your pain, CB.

I'd ask that question to Labor Relations folks in your county & state, maybe look up labor lawyers and mention the lawyer word at work if you hear any rumblings about your refusal.

No one on their deathbead ever said "Wish I'd spent more time at the office."

You are not their slave and you have a tiger inside.

Since I have a workman compensation claim that is not closed, still going to that doctor every few weeks, I'll ask that doctor for a note as well. If they fire me, I do see a law suit on the horizon as my injury required a defective office equipment that was brand new and I was the guinea pig that got injured first. All equipment was turned back to the company that made it for modifications.

Also, I am quite sure because of all the work modifications that they had to made for me at work and all the hospital visits I had last year that will be a consideration. The mandatory overtime is not used on a regular basis as well. Only during high peak-holidays and bad weather. We'll see. I had a co-worker who also has a long list of disabilities causing here to be out on FMLA and hospital visits. She actually told me I need a doctors note and what it needs to say. My doctor went a step further. It sounds like I am going to be in a wheel chair shortly the way it was written. My leg pain has increased tremendously as well as my neck pain.

Technically, if you cannot do the job that they want you to do... they could let you go. I was forced out of civil service into retirement because I could not climb ladders ( to pull cat 5 wiring) or stairs anymore.. and my job was mainly as a computer specialist installation hubs, routers, dsl's ... and software and emails systems... Just think about it, if you can't do the job they want you to do, they have to hire someone else to do the work.... It doesn't matter that its not morally right, what matters is that they can legally let you go.....

I guess you are dealing with OWCP. I think that since you have a on the job injury they will have a hard time firing you if their is anything you can do. I was on limited duty for five years with the post office before I went out on total disability via OWCP. I was on OWCP until I got TDIU and OPM disability and SSDI.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
