There is nothing that makes them want to diagnose something quicker than claiming for an undiagnosed illness. And then they just leave it at that....without bothering to develop whether the diagnosed illness should be granted SC.

they denied my gulf war related joint pain. and sleep disturbance because they said sleep apnea was not diagnosed in service, and sleep disturbances were for undiagnosed sleep disturbances, being mine was diagnosed as sleep apnea. no popsicle ,.. just a bunch of double talk and hoodwink tactics.,

“How can they outright deny me for body rash? My letter included my first episodes were full body rash 3 times in 92, although the Corpsman refused to touch me. I also included medical documentation, my wifes letter talking about me breaking out in rashes, both my kids breaking out in rashes, medication because of rashes. Shampoo meds for the rash on the head. Yet, I was denied. :”

I assume you got some retro so maybe you should contact an IMO doctor.

We always recommend Dr. Craig C Bash here but he doesn't do skin claims...he might have a good referral for you however.

Many Vietnam vets got jungle rot (crotch itch) but didnt claim it right because they didnt have the proper medical diagnosis.

You need to go to the VA SRD here (Schedule of Ratings) to see how you fit into a ratable skin condition, and determine if it is worth getting an IMO for , cost wise.

I dont think this would be anything that could ultimately contribute to your death (in that case you would definitely want SC for it) but one never knows.

“Body rash” is too generic for the VA.

I googled Gulf War vets and Rashes and I was surprised at all that popped up.

Did you ever use strong bug spray inservice?

We have info here on how to succeed in some sleep apnea claims. under a hadit search.

The VA diagnosed a Nam vet I know with acne and it was really AO Chloracne.

Does this rash hinder, by it's appearance, your ability to work...in other words was the Corpsman afraid to touch you because he thought he would catch something? And was the rash very visible to him on your skin?

The only thing that puzzles me here is that the kids get the rashes too.

Have the kids been diagnosed ?

OMG! I was reading a BVA claim the other day that denied a claim on this because the VA examiner noted that the veteran didn't have any rash on his testicles on the day of the exam. Then the judge (or lawyer writing for the judge) noted that there were no colored pictures taken of the area because the veteran didn't have a rash during the exam.

Do they actually take colored photos of your testicles to submit the the VA???

It just seems like that is going a bit far considering the fact that you never know whose C-file your photos might show up in.

Thanks for all the comments. And Berta, you are always so in depth, to the point and resourceful. As far as rashes go, i dont think i have ever come across information on why GW Vets have them. I know its a big issue though. Rashes are something that my 16 year old daughter and 14 year old son get also. I have never looked at the rating schedule so im not sure if pusuing is worth it?

After the War had ended, I was Detailed out with a large group. Our job was to retrieve all War gear. We stored it, accounted for it by scanning the equipments barcode, than eventually cleaned everything until they were spotless. We than loaded everything on MPS Ships. So yeah, depleted uranium, toxins from the cleaning chemicals etc etc. I went in depth in my letter about that.

I have never read anything on sleep apnea.

The other part of my claim was PTSD. In my 2 year wait, there has never been a C&P Exam for PTSD. I was diagnosed PTSD by my local mental health professional. So I am not sure why the bypassed PTSD. In my award letter, it states that a PTSD Exam has been requeasted. BUT, when they break down each part of my claim in "Reason For Decision"

Service connection for ptsd has been established as directly related to military service.

A noncompensable evaluation is assigned from Nov 11, 2011.

A noncompensable evaluation is assigned whenever there are symptoms that are not severe enough either to interfere with occupational and social functioning or to require continious medication. A higher evaluation of 10% is nit warranted unless there are mild or tansient symptoms which decrease work efficiency and ability to perform occupational tasks only during periods of significant stress; or symptoms controlled by continuous medications.

An at once examination will be requested to evaluate the current status of your medical condition.

So the ptsd part had confused me.

This is also what is confusing to me...... Future examinations will be scheduled to evaluate severity of your service connected CFS and IBS

Why dont they rate these as permanent? Its not like I have been getting better these past 15 years.

Just continue to go to all appts for IBS and CFS and take all prescribed medications and most likely they will just review your records after 2-5 years to see if things are still happening.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
