Dependant Disability Pay And Retroactive Pay?

Question

Within the last year my disability rating was increased to 40%. Of course this amount allows dependents to be considered in the payment amount. After getting notice of the rate increase, I applied to be compensated for the new monthly amount with dependents. Its been about nine months and I haven't heard anything. I was married and had my family while I was on active duty. My main question is .... if the decision is made for recognize my dependents, will I receive any back pay for the dependents? Thank you very much for your help!

I am currently waiting 20 months for my dependency claim to be "looked at."
I filed it 11/28/2012, 7 days after I was informed I'd been raised from 30% to 70% They had me as married, but without children.
I submitted the birth certificates and college transcripts several times online and via mail.

On 7/14/2013, I got this message on eBenefits: "The estimated completion date of 7/14/2013 is past due (Learn more)"
I had DAV send in two letters requesting some type of update -- those were ignored.

I called and got through today and was given the VA "Thank you for your service, but we have a backlog" speech.

She had no idea how long it would take and couldn't tell me how long they normally take,

I think I may have the record for this thread at 20 months waiting and still no activity.

Some of you are really lucky. I have a rating of 50% disability. VA removed my son on 18th birthday even though still in high school and graduated at age 20. Took two years to approve claim from 2011 to 2013. Audit was completed from the Navy Finance Center within two months and it was determined the VA owed me close to 3000.00. It has now been over four years since I started this claim and I am still waiting on my back-pay despite repeated trips to Indianapolis and a letter to my congressman. I believe I will not get paid till the next president goes in office.

You will definitely get it retro...eventually.

For Both my kids I submitted their dependent claims on ebenefits the day after they were born. It took 8-12 months to get it finalized....

70% - PTSD

->50% - OSA (Secondary to PTSD)

30% - Bilateral Pes Planus w/Plantar Fasciitis

30% - Migraines

10% - Tinnitus

20% - Back

0% - bilateral shin splints

I went online and added depedant (spouse). A week later I got a form in the mail from the VA with the increase in pay. I have not received backpay yet but I was surprise how fast I got the letter.

I have been trying to the right answer for my dependent retro payment. I submitted mine on 26 Sept 2011 two weeks after i got my pension,i got approved last Feb. I was told that I submitted my claim a year after I got my pension that I applied in Jan 14. I told them to look at my history and they will see when I first applied. I called for the last  year and a hlf and got different stories. Finally I got some to see the pic, they told me that I send the paperwork this past Jan and I ex[lained to them I sent it with the original paperwork, not my fault when they found. I told them that I recieved the letter on how much they held from the beginning when I got approved, they said I did not appeal, I said why would I appeal what you owe me, so they go by the start date or when they recieved the paperwork, ie birth and marriage certificate.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
