Spousal Health Care Options

Yes, ChampVA will pay the copays for what Medicare won't pay. ChampVA is a complete medical insurance with drug coverage and all the rest. My wife has it and when she gets Medicare I will drop the Family Blue Cross plan I am paying out the ying yang for now. I would not go one day without full medical coverage for you or your wife. One fall, one car wreck, or illness can blow away all your savings, and you end up with a lien on your house.

Is your Blue Cross plan from your employment or your wife's employment?

The reason I ask is I have Blue Cross family coverage from my employment. When my wife turns 65 next year I had planned to suspend her coverage with Blue Cross since she will be fully covered by Medicare and Champva and just keep self only coverage on myself along with my medicare. However, I found out I can not suspend her Blue Cross coverage because she is a dependent and dependents can not suspend their coverage but the insured (myself) can suspend their coverage without actually canceling it. If I just outright cancel the family coverage, my wife will not be permitted to sign up for the federal Blue Cross coverage in the future. I know she would still have medicare and Champva but I am afraid something could change in the future causing her to lose her medicare or Champva. Also, federal health plans for self plus one start January 2016 so hopefully my premium costs would be less than the family plan. There is so much uncertainty with health insurance these days.

Sorry for rambling on but I wanted to get your thoughts since we have similar situations.

Yes, I get Blue Cross from OPM and my wife is included in the family plan. I have Medicare now so that is primary for me. Blue Cross is still primary for my wife and ChampVA is secondary. When she gets Medicare I think I will suspend Blue Cross for her because it is expensive. For me as an individual I will keep it as my medigap. However, if you or me die while Blue Cross is suspended the spouse can't get it back. This is a dirty deal from OPM. The survivor benefit I pay for out of my pathetic pension, and yet my spouse wil lose the right to BC if I die while it is suspended! The money I get from VA is three times my OPM pension for 30 years under FERS. I get more from SSA than my pension. Most don't even have pensions. You are expected now to save for 40 years and make wise investment decisions so you can retire with a 401-K. 75% of citizens won't do this and will depend on SSA and foodstamps in their old age. I bought annuities for my wife and myself with investment money, but I think I am one in 10,000 workers who can do this and generate significant income down the road. You have to start planning when you are 18 years old for retirement.

I planned to suspend my wife's coverage when she went on medicare but I was told by OPM that I could not suspend her coverage. According to OPM, dependents coverage can not be suspended, only the insured annuitant's coverage can be suspended. My plan was to suspend her coverage and keep self only coverage for myself but OPM said no. I don't want to suspend my coverage.

ChampVA requires spouse to have medicare as first payor but it is cool cause ChampVA pays whatever Medicare does not once you meet 50 dollar annual,copay. Last year my wifes medical expense was about 140.000 and our total cost most for copays on meds was less than 900 bucks.

Veterans deserve real choice for their health care.

Has your wife ever used the "Meds by Mail" available through Champva if she does not have other prescription coverage outside of Champva?

My mother has Champva and medicare and she uses "Meds by Mail" for all of her prescriptions and the meds are free with no copays.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
