Social Security Disability ?

Question

Hello All, and thanks for the great Podcast with Bob Walsh the other day.

I really liked what he was talking about on Social Security Disability. Bob stated that even if you don't have enough quarters paid in you should still apply.

That's what got me thinking. I retired early from the Federal Government after 30 years, CSRS, 3 years ago, due to my VA disabilities. I would have worked longer if I was able to, but my disabilities told me different. During these 30 years I didn't pay into Social Security, but I did pay into the system earlier in my working career, a total of 23 quarters.

I recently got awarded 100% TDIU P&T after 3 years of back and forth with the VA.

My plan after I retired from the Government was to have a part time job to finish paying my quarters into Social Security. Well that's not going to happen now.

So, here's my question, am I able to apply for Social Security Disability even if I haven't paid into the system in over 30 years?

Thanks for all you do here at Hadit.com for Veterans.

My Spouse is filling out a SS questioner they sent her to fill out and return it in 15 days. for her SSDI

They (SSA) sent her two packets of questions, 1ST packet is asking her about her disability's how long she had it and why is it disabling her from working...I guess the usual SS standard questions.

Some of the questions are hard to answer. (and be totally honest)

Here is one of the questions

In packet number # 2

1, WHAT DO YOU DO ALL FROM THE TIME YOU WAKE UP TO THE TIME YOU GO TO BED?

questions like this is a trap don't you guys think?

She is being honest and says I get up, brush teeth, drink cup coffee go walk around outside, change some of my plants out add new potting soil, water them ect,,ect,, come back in do some things that need done around the house, sit down rest, some times during the day I go lay down, watch TV, talk on phone with a good friend

She has pain all day long and any thing she does hurts her like cooking, cleaning,... She is stricken with Bone Degenerative Disease and Osteoporosis (BAD) and Fibro,(BAD) and her pain numbers most of the time are 8 &9 Low pain tolerance is 5/6 .

arthritis in arms/legs (BAD) & She had Back Surgery and Open-Heart surgeries , she is very limited of what she can do and most of the little things like walking and even sitting she is in pain from here disabling diseases .

Some other conditions such as seizures. and take meds for that but the mdes she takes for that causes her face to swell. other complications at ungiven times.

How would be a proper way to answer that?& Questions such as these?

Thanks in Advance.

Also another question they ask on these forms.

Question

What was you able to do before your disability's arose/started?...she answered'' Everything''

What she meant by that is she could do anything that was pertinent to her care giving Job.

Should she state this?

Anybody?

Having done this myself and helped others contrary to a couple of key things to establish timelines the medical exams are the deciding factors. From your description I believe your wife is set up ok on your end.

Buck,

I don't know anything about SSDI but I wish your wife well. I wish I could help you.

Good luck to you and Mrs. Buck.
