Decision Overturned: No Justice For Burn Pit Veterans

Oregon veterans and victims of toxic burn pit exposure linked to contractor Halliburton were devastated when the 9^th Circuit overturned a landmark $85 million verdict. Soldiers contend they were knowingly exposed, but the allegations have obviously been denied.

What a shame? I was thrilled to hear the veterans were going to get justice. I was saddened to learn Oregon Federal court cannot bring justice to its citizens. What do you think?

Halliburton’s subsidiary Kellogg, Brown and Root (KBR) allegedly exposed soldiers to toxic burn pit smoke at Qarmat Ali. The 9^th Circuit held that Oregon veterans were unable to hold KBR accountable in their home state. Instead, counsel for the veterans now plans to sue KBR in Houston.

I was exposed to the same stuff and the burn registry would not take my name until yesterday when I was manually added to the system. Frankly, these contractors have big money and rarely will lose in court or ever take on responsiblity for their actions. They can hire the best and sharpest attorney's on the planet and as long as big money is in pay...justice can be fleeting at times....thanks...rootbeer22..

This was the problem:

"The San Francisco-based court did not address the issues in the case. Rather, KBR successfully argued that U.S. District Court in Portland, where the trial was held in 2012, was not the proper jurisdiction."

Geez, not the proper jurisdiction........ good thing the Agent Orange Settlement Fund had used the proper jurisdiction.

This suit seemed to be based on the same premise....go after those who created the burn pits, like in the AO matter, they went after the manufacturers of the AO.

I hope they can get into Houston court fast

Same thing goes for chemical exposure at millitary installations. The DOD will never come forward and claim responsibility. They just hope we die fast enough.

I joined the burn pit registry. I think I remember getting a thank you from someone at the registry. How do I check to see that my name is there.

I think it was throught the VA. That alone gives me no comfort...

If you joined the registry you should have had a confirmation email that stated you registered. Also both the Airborne Hazard and the Burn Pit Registry let you print of your questionnaire. Each gave that option.

The Gulf Registry exam, well I have the results but that was a joke of an exam. Dr was rude and didn't ask any questions regarding exposure. I mentioned the burn pits and unserialized and expired batch numbers of immunizations. Those facts didn't even make it in to the report. The bad guys can only dodge the bullets for so long. Once the artillery starts coming in, hell will have no compassion. Documentation is key. JMO twisted,eh, may be, but time will tell. Fight til you're last breath!
