Cp exam weight

Rate this question

Phild523

Question

I was just wondering how much weight a rater gives to the results of a c&p exam. I have heard people say that if an examiner gives you at least as likely as not that you are service connected for that issue under the cfr. Others have said that the rater does not have to go by that and only uses the exam as a piece of evidence.  In my situation I have been sent to two initial tbi c&p exams each time with the examiner saying at least as likely as not. I also went to a C&p for PTSD which I received due to or resulting from. Then the cp examiner for ptsd was asked for a medical opinion in which she said at least as likely as not.

Anyone have any thoughts? Thanks for your input.

Here is a good BVA Case to read!   Ms berta put up  this maybe the same case Ms berta put up   either way read this case.

it may shine some light your way  or at least give you an Ideal how and what maybe to expect...but I am not saying this will  happen with your claim  but it certainly could.

From the TBI exam , it appears they will rate you for migraines due to TBI-

"

8100   Migraine:
With very frequent completely prostrating and prolonged attacks productive of severe economic inadaptability 50
With characteristic prostrating attacks occurring on an average once a month over last several months 30
With characteristic prostrating attacks averaging one in 2 months over last several months 10
With less frequent attacks 0
Source VA Disability rating schedule, here in it's own forum.

The Ratings for PTSD , Diagnostic code 9411 are also there and in many posts here.such as:

I am concerned with this writeup about not applicable for the TBI question.  (the last question on the form)  I looks like you may have a few more C&P's because the TBI exam is missing.  Everything else looks good in your favor though.  I would take BUck52's advice and get a hobby and not dwell on your rating.  Once the BBE arrives that is when you check your ratings and get back with us here to find out if you got lowballed in rating.  Dwelling only makes you more anxious and stressed, we all can attest to that.  Please keep us updated and let us know how it works out.
