1 Month Elapsed Since Decision, No Decision Letter

Question

I have a case number with the VA Whitehouse  Hotline.

I have a case number for a congressional Inquiry.

I have a complaint submitted to the VAOIG.

I have called the VA toll free number multiple times to no avail.

Did I cover all the bases?

Mine took 6 months.  I had to contact my senator (all 3 of them)  I got one of their assistants to help me and within a week I got my decision and the change in benefits.  I did wait the 6 months, which I should have done the above sooner!

VA.gov said I filed a new claim on March 17, 2022.

I have not filed a claim

I asked for the Feb. 24, 2022 decision letter which VA.gov says was mailed.

This new March 17, 2022 claim does not show what the claim is for.

I called the 800 VA number and was advised the VA is doing a tracer on the money deposited into my bank.

Was also told the new claim was "internal" but I didn't think that this is possible.

I always thought a vet had to file a claim for benefits

Sometimes the VA may run audits and make corrections. If you have a power of attorney with a VSO, they can file claims on your behalf, but because they told you it was internal, I doubt the POA did that. Also, POA's tend to keep you in the loop.

The 1-800 number can look in the system and see if a letter was actually generated. They generally want to talk with you about its results until you have a copy in hand. If you have power of attorney with a VSO, like American Legion, DAV, VFW, or your state VA office, they have accredited agents who can log into the VA's system and print the decision letter for you.

I can almost promise you the VA's response:

The VA has been blaming congress, covid, the weather, or even  Veterans for decades, or anything else, for decades.  Delays are always in VA's favor.  Always.  

1.  If the VA delays you long enough you die or give up.  

2.  Even if your claim succeeds, the VA gets an interest free loan and they get another opportunity to hornswaggle you on effective date or lowball you.

Got a call from a staffer about my Congressional Inquiry this morning.

What a strange coincidence that my appeal for multiple issues has been sitting idle at the BVA for three years, and suddenly, today, my appeal is in front of a veterans law judge at the Board.

 

About the decision letter issue, the staffer has reached out to the CAVC, BVA, and the Regional Office.

Will know something soon she said.

 

About the new claim(3/17/22), I still don't know anything yet other than I didn't file it.

It doesn't say what the issues are on VA.gov

Can the VA automatically increase my rating via this new claim if the evidence supports a higher level of SMC?

 

I don't have a representative..BTW.

 

VA sent me a new medical release form for me to sign and I threw it in the trash. 

They already have 5000 pages in my C file.

               Ain't it the truth!  If VA makes a mistake they take it out of your AZZ.  They make a business out of being slow and incompetent.  You get retro and wait years and they pay no penalty for that!  I owed the VA about $250 once from an overpayment on G. I. Bill.  They hounded me and threatened me for months.  If they had owed me $100,000 I would not have heard a word.  If your claim is resolved quickly consider yourself very lucky.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
