Charles V. Shinseki
This is good news for Vets where the VA failed to notify the Veteran of a decision, and I think this applies to "unadjudicated" claims when the RO decides one issue, and "blows off" other issues, as they did in my case. http://veteranclaimresearch.blogspot.com/2...hinseki-no.html I will post pertinent parts of this: <h2 class="date-header">Tuesday, December 1, 2009</h2> <h3 class="post-title entry-title"> <a href="http://veteranclaimresearch.blogspot.com/2009/12/federal-circuit-charles-v-shinseki-no.html">Federal Circuit, Charles v. St. Paul Minnesota Letter Today
I received a classic "We have your claim and we have a large backlog" letter today. It says in the first line - " We have received your application for benefits." Some of you may remember that I won DIC at the BVA last month after six years of trying. While I realize that it will take time for the paper to make it through the mill so to speak for the award to be written, I was surprised to receive a letter from VA in St. Louis. My home VARO is Anchorage, AK. The other thing that makes me wonder what is going on is that at the top of the page under the case/file number is "Payee No. 10" and under that is my late husband's name. I have never seen Payee No. 10 befor…

Transfer Vas?
I am a patient at the VA and I have no outside healthcare. I know that all facilities are messed up in one way or another, but it is time to change facilities. I cannot receive good care at the old facility any more. The problem is transportation. neither facility's DAV will take me if I actually transfer, and I cannot get a medical transportation slip without my primary care provider's signature (which will never happen). I live in a rural area, so there is no public transportation to the next facility. If I cannot find an answer, I am done using the VA for healthcare and will deal with ER bills as they come up.

tinnitus My First C&p Exams Start Monday...
I am almost clueless at this point and feeling overwhelmed. Quick refresh on my sit-rep: retired Aug 09, filed claims in Nov 09, received QTC questionnaires this month. My wife is active duty so I am using Tri-Care when needed. I have a history of back problems in my Med Record and was seen recently for my back and knee problems through Tri Care as a dependent. MRI done in Nov results in laymen's terms from radiology and nuero boil down to arthritis of the back, when I pushed the nuero doc a little he said DDD and thinks back injections "might help". I do not have that report from him yet. I have a claim in for my back and that is one of my exams this Monday. I am look…

Disabled Vet Assisted Living And Nursing Home Care
Can someone please update me, can a disabled veteran with service connected disabilities expect extra benefits for assisted living and nursing home care? if so, is it only for veterans with dependents compensation? or those rate permanent and total. In civilian terms I think my question would be - do I and my husband need long term care insurance at all? (er, he's much healthier than I!) Thank you for any thoughts, Your Hadit'Cowgirl

What Diagnostic Code Applies
Does anyone know the diagnostic code for venous insufficiency. I've checked all the codes relating to "diseases of the arteries and veins", and by definition there is not one that fits. Also, if there is no code for the condition what do they do, how do they rate. Thank you, Bergie

ptsd Interesting Claims Advice I Found On The Net!
http://www.ptsdmanual.com/bvaappeal.htm By; Robert White I'm a former case development paralegal for the BVA. If you do the following you will have a better than average chance of winning your claim. 1. Gather all the military, private and VA medical records (get copies made). 2. Review your military medical records and make a list of every ailment that you had while on active duty. 3. Cross reference all your military ailments with your civilian ailments. If the problem persists or a secondary issue has cropped up as a result of the issue that developed during your time in the military then you need to apply for …

I've been on disability since '96 and have been to civ hospitals (instead of VA Med Centers/VA Hosp's) for treatment of the disability. Do I need to report that treatment to VA? Anybody know of the reference that states the requirement if there is one? Thanks in advance for the help.

It Used To Be That The Va Did Not Share Your Medical Info
I just found that the VA billed my Insurance company 8,000 plus. It used to be that I felt my Medical Info was not available but since they put in a claim for me I am sure that they have to share all my medical information. By the way my Insurance denied the claim :D
