Dic
I was recently given a 0% rating for arteriosclerotic heart disease secondary to DMII. If I die from arteriosclerotic heart disease would my wife then have a direct service connection claim for DIC? Right now I have no symptoms but the diseases is present. I found this out via a CT scan that was examining a lump on my leg. Sometimes pulling on a string can lead to major consequences. I had read before that DMII and areteriosclerotic heart disease were very closely related almost to the point of being presumptive.

Differing Medical Opinions ?
I have been seeing a VA psychologist for over 8 years and she is a medical doctor. The BVA sent me for a C&P mental evaluation to a psychologist who only has a PHD. And of course the C&P PHD. Totally disimised the findings of my MD. Are there any regulations reguarding two differing medical opinions and should an 8 year treating MD's dignosis and that of a 1 hour exam by a phd have the same legal weight to the BVA ? Thanks TIMR.

Closed Claim
I submitted my claim and I got turned down, according to the VA because I had not submitted all the information they requested. I resubmitted the information and I then received a notice about an Appeal and it would go thru the traditonal process. Two years later I received a letter that this is the first step in the appeals process. Normally I am on top of things, but the VA performed a hysterectomy on me and due to that have been experiencing anxiety/depression along with my immune system problems for which I am trying to get service connected, so my brain was under a lot of stress when I received this and could not deal with it. Long, long story. Now that I a…

Va Claim Backlog Update 06
http://www.geocities.com/vfw9951/docs/AFNEWS.html VA CLAIM BACKLOG UPDATE 06: The worst city in which to file a veterans’ benefits claim is Washington, where 63% of claims take longer than six months to resolve, according to a major veterans’ service organization. AMVETS, a 60-year-old group that helps veterans with about 24,000 claims a year, says a survey has shown veterans in Fargo, N.D.; Boise, Idaho; and Providence, R.I., have the fastest service, with only 6 to 7% of claims taking longer than six months to resolve. Washington may be the worst, but other major cities also are slow. AMVETS national service officer and Navy veteran Luz Rebollar said in Chicago, Det…

Cue?
Clear and unmistakable Error To VARO, I am filing a CUE on the basis that there was misapplication and misrepresentation of the regulations in regards to the decision made on April 24, 1973. I was medically discharged in December 1972. This claim was filed one month after discharge. The VA did make a decision and denied the claim. It was not appealed by me. The basis for this CUE is as follows: This is taken from the denial letter I received in April 1973 from the VARO. (Copy enclosed) "Available records do not show that you received treatment for this condition (back) during service nor was it recorded in the report of your examination at discharge." …

tdiu Social Security Disability
On Friday I got my favorable decision from Social Security. The claim was granted all the way back to Aug 2004. I have a few questions about how the VA side works. I was granted the SS based on 1 service connected thing and the other thing that I was granted SS for is NSC for now. I applied to VA 6 months ago to make the other thing SC as a secondary. What I was wondering is will VA award me TDIU based on the SS decision? I am 50% for 3 things. 30% for ddd in neck, 20% for ddd in lumbar spine and 10% for ankle. I applied to VA 6 months ago to increase the lumbar spine and to add sciatica as a secondary and to add depression as a secondary. The depression is the othe…

tdiu Va: Mri Lumbar Spine=small Osteophytes
Hello I went to my VA dr. who sent me in for a MRI for my lower back. ("56y/o man with chronic low back pain he has a mass in left sacroiliac region..) The MRI report : Small osteophytes are present anterior to the spine at all levels from L1 through L5. No other bone or disc admormality noted. There is no evidence of foraminal or spinal stenosis. Impression: Small osteophytes anterior to the lumbar spine as described above> So what I have found in research is that the osteophytes are bone spurs: bone spurs usually occur as the result of a disease or condition - most commonly osteoarthritis bone spurs form in places where they might rub against other bones o…
