How Long Did It Take Va To Send Copy Of Your C-file?
If you have ever requested a copy of your C-File, please answer the following questions: 1. How long did it take the VA to send you a copy of your C-File? 2. Did you write a simple request or invoke the FOIA (Freedom of Information Act)? 3. Was everything you'd ever sent to the VA in there? Was your file complete? If not, what was missing. Got A Strange 'phone Call This Morning
First of all, it was a strange 'phone call simply because THEY called ME. What I mean is, I didn't ask them to call me or call me back about any subject. Normally, in my dealings with the VA, YOU have to call THEM, and listen to crappy country & western music while on hold indefinitely. Secondly, it was a strange call in the fact that they ASKED me if I wanted for my two NOD's on my ankle award (#1. percentage of disability and #2. effective date) to be handled "the normal way" (read: it'll take months) or whether I wanted them to run it by a DRO, in which case I'd hear something "in two or three weeks, or less". This is established VA case law- as I called it here the Ultimate Duty to Assist-the VCAA-of 2000, and the VA defys it continually.

Would This Be A Cue?
This is taken from a denial letter I received in April 1973 from the VARO. "Available records do not show that you received treatment for this condition during service nor was it recorded in the report of your examination at discharge." Three days after my back injury my civilian orthopedic surgeon sent a letter to the post commander describing my chief complaint, past history, physical findings and diagnosis with treatment. He also stated that I was unfit for military service. On my discharge exam it clearly states several back problems and then states unfit for retention. Making Real Progress Now!
Okay, in October I filed a claim to increase my disability level for my back as I'd been bed ridden for most of the last year which I think makes me a bit more than 20% disabled. In just three months I spoke with a very nice nurse's aide who scheduled me for a 2 hour torture session at the local xray facility. Three months later I get a letter from the VA saying that since I could still do office work (from a bed apparently) my claim was denied. I filed a notice of disagreement through my rep with the VFW and was informed that it would take 10 months to hear back on that and then probably 2 more years awaiting the appeal. Iu Doctor Statment Question
Hi Everyone My question is My C&P exam is saying for Axis IV Not Able to Function. Would that be the same as saying in their terms not able to work. It look like they just didn't want to say not able to work. My Civilian Doctor Just put down due to GAF score of 45 and other Service Connections disabilities It precludes her from Function in any capacity as a employee. hypertension Award Specifics..should Tdiu Been Awarded Sooner?
We have discussed this together and have decided that we should share the entire award with the Hadit Fambly. Because there were many many issues on this claim we feel we should limit the topics to one at a time. We will need your advise but we will need to stay organized so we can continue to work this claim. We feel that there will be changes coming in benefits over the next few years, and although the award is 100% TDIU- the disability percentage is not. Sooo with this in mind we will be continuing to work the claims for increases in the ratings. We hope we can all learn from this as it certainly covers alot of stuff on one claim. I Was Told By The Va Med Center That I Am
Hi All Vets, & Family of Vets... A priority group 2. I asked what that means and was told that I don't have to pay for any co-pays for outpatient treatment for ANYTHING, even if it is not service connected. IS that true? I was also told that I WOULD HAVE TO PAY for any meds that are not for service connected. Is that true? If it is true then why would the VA say I can get medical treatment for any service or non-service connected problem and not have a co=pay, yet have a co-pay for the meds? That doesn't make sence to me. I am service connected rated at 30% pending my NOD. Thanks. Joe
