hypertension Nod Denied
I finally received the decision on the Notice of Disagreement that I filed last March. I had appealed for my back, blurred vision in my left eye, and hypertension. All three were denied. The logic that they used in the explanation was solid, and I have to say that I agree with the decision. I had hoped that one of them would get approved, but it was not to be. I could appeal, but like I said, I agreed with their assessment. When I filed the NOD, I was not real sure about the rating criteria, but have learned so much since I joined this site that I figured out that the initial rating was correct and was tempted to ask the NOD be dropped but figured I might get lucky. I …

Va Compensation
I ran into a guy on this base where I hang around who had retired after twenty years in the Navy. The subject of my 100% SC had not come up and he was unaware of my situation. In a casual conversation I told him that I work online and help veterans with their disability claims. He made a comment that was somewhat disrespectful about people who seek disability from the VA. His comment was not the type you would hear from extremists with bizarre opinions about disabled persons that you will find with some research on google. However, he was pretty much of the opinion that people should go on with their life no matter what happens to them in the military without "leaning" on…

C.f.r Governing Patients Rights During C&p
Just need a little help and thanks, I have searched, but cannot locate rights of patients concerning C&P'S? It has been brought to my attention, that my rights were violated when I had my last C&P with the two Psychiatrist when they would not allow my husband to be present. I call it an interrogation, not a C&P. It was stated to me by the Patients Advocate that it was their Prerogative to not have anyone present. I placed a complaint within 3 days of the C&P and all letters were notarized and delivered to the Patients Advocate. He did all within his power. I received a letter from the Hospital Administrator that I could seek the services o…

ptsd My Denovo Review Results...
I had applied for a "De Novo Review" and was denied. I went point for point as to their reasons for denial in the first place...they didn't even mention the original reasons they denied but came up with some new ones. Most of My evidence was not even listed on the SOC...they omited the secondary disabilities, and PTSD that I had asked for their consideration just 3 weeks ago... I will appeal to the BVA...just have to figure how the best way to do it is I will open a new claim for secondary conditions I will open a new claim for PTSD. This way it can't get lost in the paperwork as it deems to have done. It gets harder to stay sane the seeper I get down this rabbit…

House Grant
I ran into a old friend i have not seen for many years, I did not recognize him at all until he hollered at me. He is a 100% DV, he asked me a question I was stumped on, I told him I did not know but would find the answer. As a 100% DV, he has been diagnosed with a NSC disease of PAD of both legs, he stated he had been stented or cleaned out 6 times in 3 years, and the doc told him a bypass is coming soon. If rated by the VA @ 100%, does he have a chance at the house grant because of a NSC Disease?.......he cant walk very far without pain and he fears he must sell his family homestead because of the stairs and move to a ranch style home and his funds are limited. …

Ao In Okinawa
Found this in researching for a vet claimant: BVA presumptive AO exposure on Okinawa in the 1970’s Citation NR: 9800877 Decision Date: 01/13/98 Archive Date: 01/21/98 DOCKET NO. 97-05 078 Now, thanks to the diligent Veteran in this case, AO exposure in an area other than Vietnam is ruled presumptive and service connected via proof of assignment, proof of AO in the area, and symptoms arising anytime in the claiming Veterans life! May open the door for you. Ralph

Lawyers
When I filed for SS I was turned down When I filed for SC I gor turned down I got a Lawyer & got both claims approved ( Which were at different times) Does anyone out there agree with getting a lawyer after a BVA denial or to go by yourself? Seems to me government Agencies wake up when a Lawyer is introduced into the scenerio & get a lot more friendly Sure U pay 25% but that's better than 100% of nothing plus U are SC. Any opinions? Thanks for reading post GARY Seems to me the VA is able to brush off a single Vet as oppossed to a Vet with a Lawyer in his corner
