2.07 Evaluation Of Evidence
M21-1-6 Rating Board Procedure 2.07 EVALUATION OF EVIDENCE The rating specialist has responsibility to recognize the need for evidence in relation to a claim. The members have responsibility to determine admissibility of and the weight to be afforded evidence that is presented, the need for additional evidence, and the need for physical examination. If all the evidence is favorable, the claim must be granted. (See Beaty v. Brown, 6 Vet. App. 532 (1994).) a. Probative Value. The rating specialist will determine the probative value of medical or lay testimony. Accept evidence at face value unless contradicted by other evidence or sound medical or legal principles…

ptsd Schedular Vs. Plain % Rating
There is again, some confusion over schedular vs. total percentage ratings... T-Bird has put a handy link on the Hadit home page at the bottom that explains this. Yet, just to reiterate: A Schedular rating is NOT arrived at by simply adding the percentages of an award. If Joe vet is awarded 30% for PTSD 30% for Knee Injury and 10% for tinnitus... their "schedular" rating is NOT 70%. WHY is this important? The VA uses the schedular rating for thier compensation rate tables, so Joe Vet is not paid under 70% on the compensation tables... he is actually paid... 30% of 100 = 30 30% of 70 (remainder) = 21 30+21 = 51 10% of 49 (again 49 is the remainder) = 4.9 …

Designation Of Record
Well, I'm at the Court again. Just received my copy of the VA version of the designation of record and, as always, they have left out certain things that support my contentions. However, my lawyer has had a legal specialist go through my stuff and crucify the VA claims process in my case. The court's gonna love it. They, the VA, still hold a nice lump of my estate and we might get it this time. Anyhow, another of my vets has been notified that his case has been handled so badly by the military and then the VA that he has a multi-million dollar winner on his hands if he takes them to Federal Court. When he gets up from the table I hope he remembers to leave a t…

One Method Of Obtaining Evidence
One way to get evidence for various claims, is ordering your ships logs from the FOIA. In my case it was JP-5 exposure. It is not so hard to prove, if you have official ships logs which show that you were exposed to 50,000,000 gallons of NSFO (Ships Fuel Oil) and JP-5 (Jet Fuel). There is various evidence right in the Ships Logs and Narratives. My Congressman Boozman, got four years of ships logs for me from Doris Lama (CNO FOIA) Chief Naval Operations Freedom of information act. You just have to look through all the stuff to see if you can find anything. I am looking for Longitudes and Lattitudes now.

How Does This Happen?
Please anyone, How does it happen that the Veterans end up giving Power Of Attorney to an organization and don't even know the names of the people who are handling thier claim. We are giving full legal rights to an organization and have no recourse if something goes wrong and not even a name or face to put with it. This is too bizaar for the average person. How does this happen?????
