How Do You Admend A Claim For A Misdiagnosis
Can a claim be ammended because of a misdiagnosis. For instance you were diagnosed with lyphoma and submitted claim requesting service connection. You then continue to have more testing and it is revealed that you have scleroderma. Can you ask for the claim to be ammended because of misdiagnoses.

ptsd Filing My Appeal
When I appealed my 50% PTSD decision in September I just wrote an NOD on a piece of paper and stated why I disagreed and served notice I was appealing the decision. I later got a letter asking how I wanted it decided and I answered that and mailed it. I sent in all my new evidence and thats all I`ve done. Is that all I need to do? I read tonight on Military.com that I needed to file what is called a substantive appeal on a Form 9. I never did this. I hope I haven`t been sitting here waiting on nothing. I mean they must recognize it being they ask me how I wanted it decided and also sent notice that they are going to decide new claims before deciding the appeal. Ca…

New And Improved
There is no way that the Sec. of VA, can legally put a hold on AO Blue-Water Vet claims. The VA has resorted to new tactics in this AO Blue-Water Veteran claims. This is my most recent letter, from the VA for information, that is holding-up and stalling my claims. This was a request, from my Congressman Boozman, for information from the CNO (Chief of Naval Operations FOIA). Both Ships histories were sent over a year ago. These ships histories were scanned into FOIA Fayetteville over a year ago. I have personally copied and sent these ships histories over a year ago via snail mail also. I will re-fax these ships histories from my congressman's office…

"deemed Denied" Question
If a veteran doesn't receive any specific information regarding a claim that falls under the "deemed denied" category, then what does this mean for the mandatory VCAA notice regarding any claims falling under that category?

Opinons On Dr. Bash
I'm thinking of plopping down a couple of grand for an IMO from Dr. Bash. I've researched his name thru the BVA decisions and see he has been successful on some occasions but has also lost some. What I can't do is research the cases where Dr. Bash is used and S/C is granted or denied and does not go to the BVA. Maybe all of you could help. Can you give me some examples of your experiences with him. List the conditions, whether or not he had access to your SMR's/c-file or both and if S/C was granted. I know some of the differences between I/U and P&T, however, can you recieve DIC with either of these? The 10 yr. rule with DIC is for non SC and with SC, there is no time limit, correct? Also, can you get CHAMPVA with either of these or is it just P&T? thanks, sbrewer

Cavc Remand To Bva
I appealed my Service Connection claim to the CAVC, argued the case on my own (pro se) and the Court ordered remand to the BVA. The Court order provides that I can submit additional evidence and argument to accompany the remand, but provides no detail about that. I have searched the CAVC rules as well as parts 19 and 20 of the 38 CFR, and the NVLSP Veterans Benefits Manual -- but I can't find any specifics about how or when additional submissions can be made. I phoned the BVA and they tell me they will notify me prior to adjudicating the remand, to let me know about submitting additional material -- but without something in print to back it up (such as court rules or C…

ptsd Discharge Review
I wrote and mailed a brief supporting my quest for a change in the reason for discharge to a medical discharge for a service connected condition. I wrote a summery of the how I came to suffer from an extreme form of anxiety disorder and how the Army treated my incapcity as a discipline problem. When I write it all down I can see how I was rail roaded. In late 1971 the Army was trying to shed troops as Vietnamization was happening. The easiest way to get rid of a soldier with an emotional/mental disorder was to toss them out as unsuitable even if they only had 6 months left to serve, rather than pay them based on a disability.
