Amc - For Larryj Who Needed Help With Claim
Larry, I can help you with this one and it will work. I got the same darn run around, about perhaps there were medical records at the archives for me, since in 2004, I located my long lost Psychiatric records and a letter of my discharge from my C.O. Pearl told me that the letter from the archives with the medical records were due in on September 2, well like a dummy I waited, but they told me that if in the mean time, if I wanted to contact the archives for missing records and send them to them, they could progress with my claim. Not true. I send for those darn records in May and again in July and heard the same story. They had received what I sent to them, but…

Update On Blue Water Ao Claims
http://vawatchdog.org/old%20newsflashes%20...0-15-2006-1.htm (Blue Water veterans should not hesitate to file their claims, in spite of Stay proceedings) "The Secretary of Veterans Affairs has implemented a stay on the adjudication of Haas-like claims. However, a recent decision of the Court of Appeals for Veterans Claims makes it clear that the VA has not followed the proper procedure for taking such action. So, on September 28, we filed a Writ of Mandamus with the Court, requesting that the Court order the VA to rescind its illegal stay of proceedings on Haas-like claims. Yesterday, the judge ordered the VA to file an answer to our Writ by October 26…

Do You Get A C&p For 1151 Claim?
What is the standard practice for a 1151 claim - do you need/get a C&P ? I am schedualled for 4 C&P's , but none of them are for my 1151 claim/disability. It would seem odd to get a C&P from the place or even oragnizations (VAMC's) that messed up in the 1st place - I wouldn't expect them to admit it........But the records are clear (too me atleast....) So are C&P normally given for 1151 claims?

Varo Claim Development Stinks
Well we finally figured out why it takes so long to process and rate and get final approval on our claim. Yesterday we got a call from the VARO (after we sent them an email status request). The very nice lady on the phone said they were waiting for records. We asked what kind of records, she said records for gastrointestinal problems. We stated ALL records have been sent to RO and All VCAA notices are signed stating no more records available. Then I stated that we requested my husbands SMRs but we couldn't get them because ARCHIVES sent the records to the RO. She said oh yes, we have the SMRs. I said what is the hold up then. Her answer, "WELL,WE JUST HAVE A FOLDER, W…

Bva Remand C&p Sent Back To Medical Center
My first C&P was by a PHD Psychologist with a More Likely than Not Anxiety began in service. My file was transferred to another Regional Office, when the C&P results came in, as my niece is a DRO at that R.O. She had always told me that she had signed off when I was in the rating board. Not true. 5 months after I was transferred to another R.O for rating. I was send before a Board of Two Psychiatrist, Male and Female. The C&P was full of lies and slanderous accusations, none to be backed up by any of my Private or Military records. She committed fraud with the intent to deceive. I will if I have to, turn her in to the Virginia Board Of License…

Exam Secondary Condition
Hi folks, I had a exam on my right knee at Pittsburgh VAMC. The doctor said I have deterating cartlidge and arthritis with x-ray's. I am s/c 50% for lumbar and both left and right lower extrimities. I am claiming my knee condition due to my limping, and favoring my left leg. with my right as secondary to s/c injury. The RO has the exam report from the Doctor. Will this count as my C&P? Or do you think they will line me up for one? I called RO in Pitts for status and they told me they requested my file for what I don't know!! Any idea's on the rateing for my knee? VA Doctor sugessted shots and P/T, in the future canidate for knee replacement, I am not to keen on that…

Small Win But Still Riddled With Mistakes
Today I received a letter that stated the VA had finally recognized a service connected disability under diagnostic code 7203 Stricture of the Esophagus. It took a year and a half and a few IMO's from my private doctors. I consider it a win because I fought to have the 7203 removed from a grouped rating under 7436 Hiatal Hernia which encompassed Hiatal Hernia, GERD, IBS, and Eosinophilic Esophagitis. This grouped rating was in contrast to the rules established in CFR 38 Book C Para 4.114 which precludes rating 7203 from being combined with 7436. Hopefully that makes sense. In the letter it has rated 7203 at 30% but ignores 2 x-rays and 2 IMO's that demostrate an…

To Berta
Hi Berta, I just wanted to check in, say hello. I've been battling my last bout of optic neuritis (due to my MS). Anyway, a sense of humor is a handy thing to have when waiting for any type of VA decision. Well, stay warm. Holli G.

C&p For Hearing
John had his C&P for hearing yesterday, Said he was border line for hearing aid, but not as yet but if he gets a rating she could give him an amphilier for television. What bothers me and maybe someone could help me understand: When we filed for hearing loss we also filed for Menier's because of his tinninus, dizziness, and vertigo, but they did not examine him for this, we had sent in Dr.'s statements on all of this and I know that they read it all, because of making statements from the reports. What bothers me is because they never checked for vertigo and our audiologist specialist that we went to ( outside of VA) did all the checking. Will they ignore the clai…

Had C@p Exam This Afternoon
I had the exam this afternoon, Examiner was waiting for me and We spent about an hour. Very plesant. He had already studied all of the records as I took some of my copies with me. He examined me, took BP reading, It was 172/112. He said that was enough. He ask questions and very candidly said the RO should have rated it back in 1997 when they received the SMR. He looked at Heart cath info and said the measurement of the ejection fraction from a heart cath outweighs one from a stress test since it is an actual measaurement. As far as he was concerned, I should have been rated on the evidence already submitted. Now for the VA mathmeticians, What does the follow…
