Vets Who Get Email From
Jeff ( Jeff Shrade from the Senate -communications) just sent me this info- for all to know their email system has been upgraded: The Senate Committee on Veterans’ Affairs will, starting today, change the way in which news items are delivered. Later today we will send out the first release using the new system. If you notice that you are not receiving news from the committee, you can either re-enter your email address at http://veterans.senate.gov or let me know by sending me an email. In the switch, those who have signed up to receive news as “plain text” will receive it as plain text. Those who signed up for “HTLM” will receive pictures. Or at least that…

He is retired and keeps applying for jobs at Wal Mart and everywhere and no one will hire him because of his hearing. He works his but off around his house daily and is very hyper even at his age. He tells me he lost his hearing in the Navy. They were never given any kind of ear protection back then and he wo…

Va Dallas Sucks
Although I have shifted my Medical Care to my Medicare HMO I still get most of my Meds from VA mainly because of the Medicare Prescription Donut. You know when you have to pay 100% between 2250 and 5300 dollars. My Xanax was supposed to be refilled on September 13th but was not even though ordered. Another one of the VA's foulups on a controlled substance. Funny how it only happens on my Xanax but that is another story. I called and reordered over phone this weekend and its supposed to be mailed in 5 days. Meanwhile I tried to see if I could get some emergency as I am out and to make matters worse blood pressure is way up. Course when I called the VA I wouyld have t…

Axis 1 - Anxiety Disorder Not Otherwise Specified
This claim of mine is over whelming me. I know everyone is tired of hearing about my claim. I just can't let them beat me out of my benefits. I had my first C&P with a diagnosis of Generalized anxiety disorder with a more likely than not. 5 Months later a Board of Two Psychaitrist - Axis 1 - Anxiety disorder not otherwise specified Decision- nothing bothered her in service. Paragrah before the decision - she was taking librium and caffergot in service. This to me is not a plausible statement. Why would I have been taking two coded drugs. What are they saying about me with the Not Otherwise Specified?? I could wring that DRO niece of mine by …

ptsd Really Would Like All Opinions
I have filed my NOD today. Got rating last week of 50% for ptsd. All my diagnosis at c & p matched a 70% rating. Diagnosed serious impairment to social/employment funtion, mood disorders, suicidal ideation, two ph`s, combat infantry badge etc., unemployed 2 years & gaf of 48. In my denial I explained why none of the diagnosis matched 50% and informed them of being on meds daily so I can`t even drive. Informed them of my doctor relocated and started new treatment plan with new doc this week and a letter of diagnosis would follow soon. My wife also inserted a great letter describing my ptsd severity. By the way they sent an application for IU with my award letter la…

Preponderance Of The Evidence 38 C.f. R. & 3.102
The application of, "as likely as not" itself is not speculation. The " as likely as not" standard equates to the statutory standard of the " approximate balance of positive and negative evidence", accepted by VA. to grant service connection. See 38 U.S.C.A. & 5107 (:D; C.F. R. & 3.102.43. The preponderance of the evidence supports granting the benefits sought on appeal. At the very least, an approximate balance of a claim, is present to cause a reasonable doubt to exist. Therefore, I point to 38 C.F.R. & 3.102 which provides that when a reasonable doubt exist " regarding service original, the degree of disability, or any other point, such doubt will be re…

Crdp/crsc Retro Checks For Some Veterans
http://www.vawatchdog.org/newsflash/newsfl...9-18-2006-1.htm "A small group of disabled military retirees this month will be the first of 133,000 to receive lump-sum back payments, say officials with the Defense Finance and Accounting Service. The trickle of payments will become a geyser at the end of October. Officials say 40,000 more retirees will see payments deposited electronically in their bank accounts by the Department of Veterans Affairs, DFAS or both. Payments will vary from several hundred dollars to $10,000 or more. The average will be $3,700. Almost all retirees in line for the pay served 20 or more years and all have disabilities that made them…

Large Asbestos Lawsuit Won Friday
http://seattletimes.nwsource.com/html/heal...sbestos22m.html Friday this story broke- The asbestos vet I have has also become part of a lawsuit- dont know how that is going- there are numerous lawsuits involving asbestos against the manufacturers. I think any vet with an asbestos claim should get in touch with any of the lawyers who have filed suit against these companys. Particularily if they have mesothelioma-they should definitely look into these lawsuits. The above class action award of billions took 5 years-I have kept up with it but found out yesterday that it had been won late last week. The average payment is about $140,000-150,000---not much bu…

Asbestos Claims
This claim shows how the VA determines asbestos related service connection. http://www.va.gov/vetapp06/files3/0615513.txt The veteran's SMRs were destroyed in the fire at St Louis. The veteran had been a long term smoker. He also-post service-was exposed to asbestos- at first glance this claim looks impossible to succeed. The veteran did some leg work- he clearly gave the VA a good idea of what he did in service and sent them some pictures of himself while at work in the military. An initial remand of this claim received a VA doctor's favorable opinion and the VA stated the more than likely stuff and supported this with a medical text. There are si…
