If you have the NYSDVA on your POA and have reason to believe you have not gotten adequate representation, send me a brief PM as to why you believe that occurred and I will see what I can do-I am focusing on claims filed at the Bath Office of NYSDVA. If the RO denied your claim and you did not get VCAA election notice and statement specific to what evidence you need- or if your evidence is being ignored by the Buffalo VARO- pertinent medical evidence that they are not addressing in any SOC or SSOC- and you feel that your POA (NYSDVA) is not being responsive to you-PM me and I will see what I can do. If your claim went to the BVA give me a docket and citation for it…

For now- you must file or re-open your claim ASAP. If you have a disability on the Agent Orange Presumptive list and received the VSM, file or re-open any denied claim under the Haas decision. Tricare For Life (tfl) And Medicare
What's a real old military retiree to do? Fewer and fewer doctors and clinics are accepting Medicare which negates TFL. One is no good without the other. It's like having a car and no gasoline or a gun without bullets. And these clinics are not giving any advance notice. I showed up for my appointment last week only to be abruptly told that they no longer accept Medicare (even if TFL is the second payer). The receptionist handed me my records and advised me to go online and look for local "physician finders." It looks like I'll be forced to throw myself on the mercy of the VA hospital.
