Md Statements: Opinions
I have been reading the board and have come across the following. You have a MD statement that says it is at least as likely as not, is most likely, was due to. I received a SC for a least as likely as not ( 50 percent sure) I have 2 C@P opinion from MD not NP that state most likely. (75 percent) I have 1 from same doctor that says was due to. (100 percent) I have no decision because this has been going from the rating team to the development team back and forth. I feel confident I am going to win, But they are really messing with these claims. Has anyone ever been denied and had a MD statement at the least as likely and and over opinion?

Storage Of Old Military Medical Records
The Management Center in Washington D. C. has told me over the telephone that they were expecting any old medical records of mine to be in their office the week of the 2nd of September. I called yesterday and one of the counselors told me that she hoped that they were faxed to them this week. The BVA has ask for a search for old medical records to see if there are any out there that are not in my file. This would be because in 2004, I turned in all of my psychiatric records and a letter from my commanding officer, to which the VA had never seen. I filed my first claim in 1978 and the only reply of decision was a letter that stated " you are not service connected…

ptsd Personal Assault Ptsd
I am in a claim delima, I have 5 claims pending at the Rating board and one just past the DRO process. I am contemplating filing for PRSD. There are 2 documented stressors and both are listed on the Servuce record and I also have logs. I was awarded Direct SC for the Neck Injury I sustained during one of the stressors and both stressors are related. My delimma is this. Should I wait to file or do I need to go ahead. The other claims are some of the oldest in the VA system, according to the 800 number. If I file a new claim WIll the VA start from scratch again and cost me 2 more years.

C&p For Barretts Esophagus/ Bva Hearing
Received call from OPC Clinic today, askinf if i ever had a C&P for my Barrett's esophagus claim which will be going before the BVA in OCT.. I told them that my claim has been in for three years, and i never had a C&P for Barrett's Esophagus. all the evidence i have on my Barrett's comes from my Fee-Base Gastro Doctors, all the endoscopies and biopcies diagnosis were by my Fee-base doctors approved by the VA. my claim is a secondary to my S/C gastritis/Gerd disease. I ask since the doctors were my fee-base doctors why would there be a need for a C&P, All my endoscopies show besides Barrett's, Gerd disease, Gastritis, Hiatal hernia, erosive esophagus. Qu…

Veterans Service Officer Competency Program.
I just had an Idea, I have read so many horror stories about VSO's passing out bad advice over the years. I have had 1 from the DAV that totally destroyed a claim I had because he put the wrong information. I am getting sick and tired of seeing Veterans get the same old run around by these people. I believe that there should be a competency process for anyone who desires to be a VSO. There should be a test administered to all VSO's and the ones who do not pass it, send them down the road and get ones who can pass. I am willing to bet that over 50 percent of current service officers cannot pass a test that pertains to VA regulations and ECT. This is extremely s…

tdiu Interesting Recent Cue Decision (granted)
http://www.va.gov/vetapp06/files2/0603319.txt "FINDING OF FACT In reducing the veteran's disability evaluation for schizophrenic reaction from 100 percent to 70 percent effective May 1, 1970, the RO did not apply the correct law as it existed at the time of the February 1970 determination; as a result, the February 1970 rating decision is fatally flawed." This recent one is interesting too- the CUE regarding the physical disability was denied but the CUE claim triggered a remand for TDIU: ORDER The January 1969 rating decision, which reduced the evaluation of encephalitis residuals from 100 percent to 30 percent, effective November 25, 1968,…

Tracking Your Mail To
If you use Priority with tracking slip or certified mail- remember to track the mail on line at USPs -dont put any hyphens into the tracking number -just the same spaces as the number has on the receipt. Asl them at the USPS site to email you confirmation of future activity- I print out confirmations from USPS for all VA mail I send. I was concerned about something- I used certified but days went by-no green card- USPS just verified by email that the VA got this. A proof of mailing with delivery confirmed at the VA means the mail is in VA's possession- what they do beyond that -----who knows--but the USPS confirmation is the proof that VA has what you sent.
