What Is The Difference Between A Grave Procedural Error And Procedural Error?
I have been researching my claim, just in the event that I should win and have read and read about CLUE and GRAVE PROCEDURAL ERROR AND PROCEDURAL ERROR. Could someone please explain to me what the difference is in the three? Thanks, Josephine

P & C Exam
Hi, I just got my notice from the VA to go for my P & C exam next week, although I haven't received my "old" medical records from St. Louis yet. My records, since finding out that I have HEP C, are pretty extensive and complete. Should I take a copy of these with me for the exam? Any pointers or advice as to how much information I should bring to this, anything I shouldn't bring or admit to? I do have a NEXUS letter in my VA Medical folder and will be getting another from my civilian GI doctor after he has had a chance to review my "old" records. What should I ask for in the way of a transcript or a copy or the medical record from this exam? Thanks, Dan

Crdp For Under 20 Retirees?
CRDP eligible too? Under 20 retirees recieve unbiased VA disability, only retiree pay reduced by small offset (TERA retirees).curious. cg

duly constituted appellate authority or except as provided in 38 C.F.R. § 3.105 Will someone explain this to me ? I think it woul equal BVA versus RO but am not at all sure. Thanks carlie

diabetes Va Cued Themselves Due To Vcaa Violation-i Think
It appears that the RO ,upon receipt of my CUE request of Aug 22,2006, has cued a past VA decision and VA has re-opened - my claims of direct service connection of Rod's death due to AO. This is not my two CUES on them-in adjudication- This is a request for the VA to CUE itself. They can do that-and did this for me in the past on 2 or 3 decisions. I can only assume this from limited info so far- and even had to cancel a Wednesday appt with my new vet rep because of the Blue Water Vets astounding AO news. He said they are doing all they can too to get this Haas decision out to affected vets too. I will copy and paste the VCAA Cue request I made to the RO VSM: …

Oh No! Need Translation
I couldnt' find it- I made one here years back- I found the Military acronyms here but not one for the VA lingo- My new vet rep has been most attentive with calls and emails since last week- but I speak and write in VA initials and he doesn't seem to understand many of them- anyone remember what I mean and what it was called under the search? I just sent him a complete summary and status report and some background on my claims but half of it was VA initial lingo and I forgot he already asked me to translate some email VA acronyms I sent him- Thanks all

Babe In The Woods
Boy! I wrote in my introduction that I hope to help someone else through my 35 years of experience in dealing with VA. After surfing this site however, I realize it is I who can benefit from all of you. My horror stories don't even begin to measure up to the things I am reading. Man, I've had a cakewalk compared to many of you. The things that I have learned however are: VSO's generally are far inferior to VA in their knowledge of VA regs. This doesn't bode well for all of us. Also, Lawyers are generally speaking not familiar with VA law and I'm not sure that this new rule will actually help many vets. Haas -ao Vets- Law Of The Land
Again please let any Blue Water vet you know of about this wonderful decision- One of my AO vet orgs did not hear of it until I emailed them on Saturday- My Updates from NVLSP are at mil.com too- An affected vet *should take a copy of the NVLSP statement and any past denied decision to the vet rep-re-open or file a new claim. Blue Water vets with presumptive AO disability and the VSM or in some cases the AFEM unless duty was high altitude fly over.

If Your Imo Was Ignored
I have accumulated sufficient evidence to prove that my $2,000 buck IMO was never reviewed, read, or considered by the Buffalo VARO at all. In Nov, it will be two years that they have had it. Although I sent 8-10 copies of it -and more if I count the backs of other VA letters that I copied it to- so they would see it- I feel I have incurred "Property Damage" to the tune of $2,000 and I expect the additonal $2,000 IMO I just requested will be ignored to. I am filing a SF 95 ,the first step in suit action against the VA under the FTCA and asking them for my money back. ptsd Morning Reports To Help Rvn Vet
I need to be reminded where to get these reports. My 2 tour RVN : vet served from 22 Mar 1968 through Honorable Discharge 14 Mar 1971. Decorations: NDSM -- SPS M-14 -- SPS M-16 -- VCM -- VSM -- 2 O/S Bars In Aug 1973 he was denied SC for "nervous condition" -- not shown by evidence of record. Drug addiction -- disability due to willful miscondust. HE IS CLEAN and HAS BEEN FOR MANY YEARS. I do know him well. ptsd Seeing Psychiatrist Monday For Diagnosis, Any Advice
Good Evening, I'm headed to the doctors office Monday morning seeking an "Independent Medical Opinion". My original diagnosis' came from my family practioner. I know the VA will balk at that so I'm looking to back that up with that of a Board Certified Psychiatrist. Is there a special format that he must follow? I'm being seen for PTSD, depression and anxiety. I've tried to locate protocal, can anyone point me to it.... Thanks!
