ptsd Appeal Question
In 1997 my claim (re-open of the dead veterans PTSD claim)was transferred to the BVA but then within 2-3 months this claim was awarded at the RO level due to new evidence-and they sent the check- I never dealt with the BVA at all. (OOOPs forgot- My CUE claim of 1998??? was denied at the BVA -I did not pursue (I actually believed what they said in the denial like a dope) but VARO counsel awarded this CUE in 2004??? forget when- My question is- When your claim gets transferred to the BVA (They said they have it- I had a nice chat with the sec there-as I asked for a Remand) do you still get a packet of BVA info and the Appeals Process literature from the BV…

Some Of Y'all Are Gonna Get A Check..........
Some of y'all have some money headed your way. "The departments of Defense and Veterans Affairs have worked out a plan for sharing the cost and the task of delivering about $500 million in back pay to more than 100,000 military retirees with VA-rated disabilities." I got this off of military.com where the full article is posted.

Doctors Letter
John will be going to the VA office on Aug 2nd. I wrote a 4 page letter out about all of John's problems including about how his depression, paranoia and anger play in. Took the letter to the Dr. yesterday and he said it sounds good and wanted to know if there was a form that he should fill out to confirm what I said or are we to wait till VA contacts him. The Dr. is very much willing to help us out with this. Thanks in advance for your input. John's Wife

Insurance And Medicare
My Brother has just recieved his rating this last month and VA is now giving him a physical, all the doctors he has seen in the last week have been real helpful to him and yesterday he had to go for a hearing test and they are going to give him two hearing aids on for each ear. He asked me what he should do about his insurance and medicare plus medicare d. He doesn't know if he should keep it or not. I said I would get on line and ask you guys. Should he keep his supplemental insurance and medicare d now that VA is helping? So far he has been rated 50% but his VA Rep. feels that he can get 100% but one step at a time. Need your advise Thanks John's Wife

Back Injury Nod
Just would like you guys to take a gander at my NOD. I plan to submit it tomorrow (oops did not see the time so I guess it will be today). I will check hadit at work to see if anyone has any input before I mail it out. I know that I should have done it earlier but hey, they keep me busy on my previous NOD which contained 10 issues and finally went to a formal appeal after a carbon copy De Novo Review and a SOC that was only two pages long for the entire 10 items. Trying To Help A Veteran With A Claim
I'm trying to help a veteran with a claim for a lumbar spine condition. He was service connected a couple of years ago at 0%, filed an NOD for an increase, got a DRO review, the DRO concurred with the VARO's original decision, and now he's got the BVA filing paperwork. Here's the problem. The VARO denied his claim for an increase because he was involved in four vehicle accidents between the time he was discharged and the time he filed for an increase (incredible as it sounds, he was not at fault or cited for any of them). The VARO is regarding these accidents as the cause for intercurrent injuries that worsened his service-connected back condition, without providing a…

? About C&p
When you have a C&P, your c-file is also read, correct? To bring you up to speed-my husband put in a claim for mental increase and went from 10 to 50 within about 2 months. He also filed an 1151 for his toe. It was denied and appealed. He was then sent for the C&P for the toe. He never got a copy of the mental C&P, but did get the toe C&P. In the toe C&P under general remarks, the dr. notes "I also noted his long history of severe depression with suicide attempts". Question- Should he had gotten 70% instead of 50% (I do know that his GAF on mental c&p was 53) if so, should he appeal this decision and how long do you have before it's too late to …
