ptsd Sexual Trauma
If a female veteran experienced sexual trauma while on active duty and did not report it but hid the fact that it ever happened even from her husband have a chance of winning a claim for ptsd. this happened to her after serving in the army for 6 years she got out in 1979 because of the incident. Her marriage ended shortly after her discharge. She has suffered in silence since that time .I would like to help her but don't have a clue as to where to begin. There is nothing in her records about it and even now she is not trusting of anyone. She never knew who her attacker was. Please help if you can

Berta, 4.7 Not For Application In Cue?
Berta, (or anyone) I thought 38 CFR 4.7 was the "preponderance" rule. If not, do you know what is? "4.7 Where there is a question as to which of two evaluations shall be applied, the higher evaluation will be assigned if the disability picture more nearly approximates the criteria required for that rating." The reason I ask.......... http://www.va.gov/vetapp03/files/0331675.txt states that "provisions of 38 C.F.R. § 4.7 regarding the higher of two evaluations are not for consideration in CUE claims. tinnitus Increase In Bilateral Tinnitus Rating - Cue?
Last July, we filed with the VARO for an increase in my husband' bilateral tinnitus rating from 10% to 20%, per the CVA's decision in Smith v Nicholson. We haven't heard anything yet other than the canned letter saying "we're still reviewing your claim," etc. The effective date of his claim is sometime in 1998 (can't remember exactly when), so do I have to CUE this in order for it not to be regarded as a new claim? We want the increase, if granted, to be retro'd back. Thanks.

Boot Camp History
Good evening: Is there anyway I can get some type of unit history for my boot camp company? I have tried numerous times to get my boot camp records from the records place at St Louis but the first 4 years of my service record is always missing & yes I have let people there know I have broken service. Do any of you know of any sites I might visit to get a history of basic training I went to NTC Bainbridge MD & I was in company 7223. meanwhile I will keep plugging on the Internet. Liz

C&p Coming Up
Anyone have any idea what exam of what the doctor might be looking for? I was in the NG, my wrist was injuried when some equipment fell on me. I have a LOD for the accident. At the time my wrist did not bother me, I was just shook up and sore all over. Well 2 months later the pain was so back I had to go to my civilian doctor, its almost impossible to get the guard to pay for anything. She did some tests and said I had been in an accident and I had trauma induce arthritis. I had 3 cortizone shots and the pain went away for the most part. I submitted all this with my claim. That was 15 years ago, now the pain is back in my wrist and runs up to my elbow. Things hurt…

Reasonable Risk ?
I had a bad toe pain, VA Podiatrist tried a couple of non surgical steps, then we went with surgery. After surgery the toe would not bend. I went back for Physical Theropy and 2 months later it still does not bend. I filled a claim for 1151. They turned it down, stating I did not show where the Dr. was careless, neglectfull, lacked proper skill, or that it was not reasonably forseen. The Dr. talked about risks with the surgery such as, infection, reaction to anastesia, scar tisue, and loss of sensitivity due to cut nerves. I related to the last two items due to previous surgeries and agreed to go forward with the surgery. In my mind, the loss of use of this toe …

Ops In Support Of
Something here made me think of this today- many troops were in service battalions that were directly in support of combat troops-(like Signal Corps , Communications, etc) to support a service nexus- when the veteran's service records might be devoid of each operation-the veteran should try to access the unit's history that they were in support of--- as well as their own unit's history--- does that make sense?

Re-opening File Question
My husband is 10% for depression and has been since 1980. He was also on TDRL and when that ended they kept his VA check until that was paid back. He found out today that the VA had his info under the wrong social security number. Can he re-open a his claim from 1980 and if so how does he do this? If there is an increase would they owe him back pay from 1980? Thanks, sbrewer

C&p Exams Are Done
Well the triups to the VAMC are done, now it is back to a waut and see what the VARO decides this time, the shrink, took longer this time, instead of 10 minutes she took about a half hour and wrote far more notes, asked about when I last worked, the fact I have no friends not even casual ones, that I isolate, she asked about my symptoms and the frequency, the things I think she should have done last year, but at the end she made a strange comment that left me wondering, she asked how I felt if my wife was appointed my guardian, I said it really doesn't matter to me one way or the other my check is direct deposit and my wife pays all the bills and there is always money w…
