1151 Claims
Question for BERTHA: I had to resign from my job as a Correctional Officer in Dec 1999 because of SC back and knee problems. When I left my back condition was nowhere near as bad as it is now. I've been followed with Xrays, CT Scans, MRI's , ect; since. The only treatment I've received is with medication. I was recently sent fee basis to a spine clinic where the report said I have severe spinal stenosis with nerve root inpingement. The spinal stenosis is now to the point surgery won't help. The only thing that can be prescribed is a shot which I had a couple weeks ago. It has helped a lot. Don't know how long it will last and can only get six a year. I also suf…

diabetes Hbp Cauing Retinopathy Granted Seconday To Diabetes Mellitus
Vets often fail to realise how many secondary conditions they can get secondary SC for due to DM II. http://www.va.gov/vetapp05/files2/0509997.txt I have a vet who is in same criteria as this claimant- the VA did award him 40% months back- they forgot the rest of the award- it should be 100%- They are working on that. He has cataracts from the diabetes and has had two heart stints. And an SSA award for the SC diabetes. This above decision shows the steps needed to medically associate HBP to DMII: no other known NSC etiology for HBP and direct medical nexus of the HBP to the DMII--- dont forget -HBP is well known to the VA to be potentially secondary to DMI…

ptsd Duty To Assist? Is This Still Required?
I had the reg for VHA Directive 2000-29 which was the directive mandating that VA dr's had to give a written opinion if asked on your disability effects on employability and such. I noticed in my research to print said directive out that it expired in November of 2005. Is there a new Reg ? I've got an appointment with my PTSD psych on Thursday and was going to request that she give me this, as I'm getting ready to finally follow through with my TDIU. I was SC with PTSD at 50% in the spring of '05. I have yet to NOD or CUE as I had a claim in Voc Rehab, and they want my dr's to state on my employability. I'm 70% total with PTSD and DDD. Currently I'm in a lu…

Dic--survivors Of Pow
uNDER 38 USC 1318 if a FORMER POW DIED AFTER SEPTEMBER 30, 1999 AND WAS RATED 100% FOR ONE YEAR OR MORE PRIOR TO DEATH A WIDOW CAN RECEIVE DEATH AND INDEMNITY COMPENSATION. I'm still advocating for veterans, their dependents and survivors while I am attending college. One of the people I encountered recently is a homeless disabled man who is not a veteran but is the son of an elderly vet in a rest home who needs help on a claim. This disabled man told me about a former POw's widow who lives in Plains, Montana twenty miles from where I live. From the internet I found out about 38 USC 1318 and told her to apply for DIC because her husband died after september 30, 1999 a…

diabetes High Tryclerides And High Chloestrol In Vnvets!
Kelley asked to post his reply to me regarding this topic. What say you guys!! I know Joe is being treated for it with Statins and Niacin...Am wondering what the statins are doing besides lowering the T/C? Especially with him being poisoned already with Herbecides!! ....Kelley responds....to ...Please post this wherever this comment came from. leistef: You can always file a claim. Whether you can obtain a successful outcome or not, is another issue. Every successful claim requires a diagnosis of a disabling disease or condition. Do you have a diagnosis? High cholesterol isn't a diagnosis, it's a lab finding and isn't, in and of itself, compensable. You m…
