Question About Psychologist's Verbal Opinion?
As I stated in a previous post, I had a difficult time last week that ended with a 72Hr self admit to the local VAMC Psych Ward. During the time their I took the MMPI test at their request and then discussed some of my answers, which if read out of context, whould have definetely led to a borderline Schizophrenic diagnosis. After having spent some time with the Pyschologist, she was able to more accuretly determine the results of my MMPI test. I am currently rated at 50%. for ptsd.My question is this...if I do go thru the in house program in Topeka ,would it be beneficial or detrimental to me getting a % raise...or have no effect on it. John

Appeal Cancel
I just got notified that one of my items on appeal was granted locally at 10%. There is also a 30% rating for the condition. The RO wants to know if I am satisfied with 10% and if they can drop it from the rest of my appeal to BVA. Do you always automatically continue an appeal like this for higher percentage, or are there times when you should agree with the local decision?

Will Senator Bid For Help Slow Down Claim?
I have 2 appeals pending that was remanded back to VARO in October 2004 and also new secondary claims filed in March 2005. This summer I wrote my US Senator for help with my issues and he sent me release forms to sign and send back so he could check out my issues. I was reluctant because I thought it may slow down my claims and appeals even longer. He contacted me again today and sent release forms again. If he gets invovled now will it slow down my claims. The Varo said in an online inquiry today that they are about to bring the file to the claims unit so the new claim can be worked.

Vet Has Idea- Needs Refining- Help Vets W/ Pleading Va
Hey, everyone! Tanks! for everyone for help with claims! (wink!) My idea: Hire someone local who does legal-type documentation- NOT an attorney (that is illegal!) but someone who is good making an argument. Maybe a legal student, a paralegal, or just a secretary with typing skills. What do "you all" suggest, what kind of usual job would help a person be useful for this? I live near a town with 60,000 people, so keep that in mind- not the big city. Pleased, really, actually happy to find and meet you all via Hadit! Berta, One More Cue Question.
Berta, I beg your patience with another question about CUE. I did read your blog and the VA info, but I'm confused about a CUE I working on. I think the VA failed to apply the higher of two evaluations, but that gets really close to saying they didn't interpret or weigh the medical evidence right, which of course is not grounds for a CUE. This condition had been treated for 25 years before the C&P exam. In 2000, the decision awarding the lower rating quoted the C&P examiner indicating “chronic venous stasis changes in the distal extremities with hyperpigmentation at the distal tibia with loss of hair.” I think the VA failed to apply the higher of two ev…

Update On My Claim
DRO decision was made on Dec 14th and the claim went to the VSO desk- where the vet reps and VSOs pick up the claim-and usually for DRO review, they argue to expand and often they or the DRO calls the claimant-or they can sign off on the decision- I have a great vet rep at the VARO- he knows I have additional evidence to expand if needed- well he didnt call me or email me and today they said (800#) that it went from VSO to "an adjudicating clerk". I dont know how to interpret that- I am almost sorry I called- my baby girl who made me file this claim in 2003 is coming home for a week- hope I dont have to deal with the claim while she is here- I have only s…

ptsd Can You Send In 2 Claims At The Same Time
Hi, just wanted to know if a person could send in a request for P&T and a request for getting s/c for new things to his PTSD. All is new information not sent to VA R.O. in the past. Or is it better to send in 2 different claims. Since this is new information ,I don"t want them to get one claim first and say I can't use some of the same new informatioon on the 2nd. I hope this makes sense I am trying to help some one with this .Thanks Mary

Filing A Cliam Under 38 Usc 1151
Greetings, When a claim is filed under this section what is the compensation under this law? I mean there is not a ratings guide for this section. Can anyone help? or is there anyone who or known anyone who has filed under section 1151 concerning side effects from meds and the lack of the VA not checking the meds for interactions and this resulting of serious side effects?. I appriciate the comments from Berta. Thank you.

Berta I am 20% DDD (cervical spine). I filed a request to reconsider and new claims listed below (all were filed at the same time). When I went for my C&P the following was determined: Chronic Pain Lumbar/Thoracic - as likely Aniexty/Panic Disorder- more the likely Gasrointestinal Condition - clearly related Scar on neck - result from surgery These claims were not evaluated but were mentioned in the reports: Migraine Headaches Cervical Radiculopathy The following claims were not mentioned: Tendonitis Right Elbow w/Shoulder Pain Arthritis Right Wrist Arthritis Cervical Spine What is up with this?
