TDIU Claim
Hello to all my fellow vets! I was curious about the process and the forms that are needed for tdiu. I was sent a request back in May, to fill out and return form 21-8940, which I did. It took 30 days for the review and then I recently got another request this month for form 21-4192. My last employer has filled it out it has been submitted as evidence. Va.gov website is counting down the days until its due. Its says 22 days until its due. I turned everything needed as of now, but I wanted to ask, does anyone know what happens after they receive the 21-4192 form? I wanted to add that when I did my C&P exam, the doctor was asking me a lot of questions about my e…

What is this private company doing reviewing vets' medical records?
URL below is to a job posting for apparently someone off the street with only an HS diploma to review vet medical records. Name of company is Maxim Healthcare Services based in Philadelphia. Is this something new? Why is this being allowed? I was under the assumption that vet cases are handled by trained doctors and psychologists at a minimum. https://www.indeed.com/viewjob?jk=e7ab19035746f5ec&tk=1ecf1oadcovm1800&from=serp&vjs=3&advn=8600910873538342&adid=268753156&sjdu=lWi5ePLDRnMc0VlxfzXY7q5DE9ynfqsOG4Vzx876sMbDkcIiVP0ykd_ak7VrxfaZzVdb_562WZ9HzgD96qfVNdjxGkMj6gbANjH-hxmpGN0ywtR3PVXxk8Jd9AuWvyOV

Protected Environment
I am looking for help...what is the interpretation of this policy by my previous employer: (VA medical center. d. It should be noted that if an employee is no longer qualified or able to perform the essential functions of the job, VA is not ordinarily absolved of the duty to provide reasonable accommodation. I am trying to justify that the accommodations provided to me were not reasonable accommodations and I was in a "protected environment" during the last years of my employment Provisions made were: 1.Permanent change of shift until my retirement, not availed to anybody. 2. Hire…

Is it possible to get a letter stating I am unemployable?
Hello, Since 2011, I have done my best to chug along while dealing with the bumps and bruises of war. The VA rated me as P&T in 2018, at 100%; which I am so grateful for but I am now needing to lean in for SSDI. I was rated for a cervical neck fusion, which only partially repaired a nerve problem and I have chronic migraines, and lose feelings in my hands. I also have PTSD, Major Depressive Disorder, Adjustment Disorder, and Panic Disorder. I have needed to work from home, as an ADA accommodation, since 2015. As of 2017, this has become even more of a challenge and I have been on medical leave after medical leave most lasting over six months. In 2018, I attempte…

UPDATE George Donovan
I am posting the status of George Donovan here in this group for all who knew him. He was like a father to me. I love him like family. I asked his daughter if it would be ok to post about what George Donovan's status currently is. I know that I do not have all of the answers to help my fellow Veteran's, but I promised George Donovan aka DGastone that I would pass on what he gave to me and to do my best. I will always continue to do this. I was brushing up on as much as I could the past couple of years and now feel I can be of some assistance. I get a lot of rebuttle but that is ok I WILL NEVER GIVE UP GEORGE. Anyways the following is what Mr. George Donovan's daughter tol…

Reaching the conclusion of this process, ? about TDIU
Hi everyone, I am currently SC at 80% Tinnitus 10% Hearing Loss 50% Headaches 50% = 78 rounded up to 80% I have not worked at all since Jan 3, 2016 due to my SC disabilities. I have a PTSD REMAND pending at the RO with a C&P on 8/9/2019 that contains line(s) that specify, OCCUPATIONAL AND SOCIAL IMPAIRMENT= [X] Occupational and social impairment with deficiencies in most areas, such as work, school, family relations, judgment, thinking and/or mood It is my understanding that this level of ..impairment.. may fall into the possibility of 70%, but not necessarily a slam dunk by any means? ...OPINION AS TO WHETHER IT IS AT LEAST AS LIKE…

To consider
NOTICE TO ALL. I am posting this to show one important piece to be used in being approved for TDIU. I AM NOT SAYING IT IS THE ONLY THING NEEDED FOR A SUCCESSFUL CLAIM> I HAVE NEVER SAID THIS....But.....This Vocational Opinion shows the value VR Counselors have in there professional opinion with SSDI and SS claims. This also believe it or not is very successful and valued in TDIU Veteran Claims. In fact I have read at one time it was suggested the VA include this VRC opinion with claims. It was not taken up by the VA. I WONDER WHY. A vocational expert (VE) is an "expert witness" called by the Socia…

TDIU and VR Chaptor 31
Winning a TDIU Claim: A vocational expert’s perspective Guest post by Vocational Expert Patrick Clifford, November 16th 2017 So the VA has told you that you are not disabled because they believe you can perform sedentary work. You may ask yourself what is sedentary work and how did they determine I can perform in light of my disability? What is sedentary work? The Bureau of Labor Statistics breaks up the world of work into five categories. Sedentary, light, medium, heavy and very heavy. The definition of sedentary work is as follows: Exerting up to 10 pounds of force occasionally (Occasionally: activity or condition exists up to 1/3 of the…

The single greatest evidence one can have for both SSDI claims, and, or TDIU claims Unemployability is to get a FREE, keyword, FREE, evaluation from a chapter 31 VOCATIONAL REHAB Specialist.
